版权技术保护措施及法律规制研究

【摘要】： 数字环境下随着网络技术与信息技术的高速发展,互联网上的信息量迅速膨胀,而便捷的数字化形态使复制、传播变得轻而易举,正是这种便捷性增强了侵权的范围和程度,盗版和非法使用严重影响了著作权人的利益。面对相对高昂的司法维权成本,版权人更青睐于利用技术保护措施控制他人未经许可对作品的访问与使用。世界知识产权组织和主要国家也将对技术措施的法律保护纳入版权保护范围。但是,法律对技术措施的保护又引发了新的制度冲突,它对于昔日作为版权人与社会公众利益的最佳调节器的合理使用制度造成冲击,破坏了传统版权法中已经形成的版权人与社会公众的利益平衡。因此,各国在其对技术措施的法律保护中也规定了规避技术措施的例外情形。我国对于技术保护措施的立法起步较晚,有很多不尽完善的地方。本文主要采用案例分析法、归纳分析法与比较分析法阐明技术保护措施相关的法律问题,技术保护措施与合理使用的融合,并在比较其他各主要国家立法现状基础上对于我国技术保护措施的版权法保护现状分析并提出建议。
[Abstract]:With the rapid development of network technology and information technology in the digital environment, the amount of information on the Internet expands rapidly, and the convenient digital form makes replication and dissemination easy. It is this convenience that enhances the scope and extent of infringement. Piracy and illegal use seriously affect the interests of copyright owners. Faced with the relatively high cost of judicial protection, copyright owners prefer to use technical protection measures to control the unauthorized access and use of works by others. The World intellectual property Organization and major countries have also included legal protection of technical measures within the scope of copyright protection. However, the protection of technical measures by law has caused a new institutional conflict, which has impacted on the system of rational use of the best regulator for the interests of copyright owners and the public in the past. Damaged the traditional copyright law has formed the interests of copyright owners and the public balance. Therefore, in their legal protection of technical measures, the exception of circumvention of technical measures is also stipulated. China's legislation on technical protection measures started late, there are a lot of imperfect places. This paper mainly uses case analysis method, inductive analysis method and comparative analysis method to clarify the legal problems related to technical protection measures, the integration of technical protection measures and rational use, On the basis of comparing the legislative status of other major countries, this paper analyzes and puts forward some suggestions on the copyright protection of technology protection measures in China.
