数字版权管理模式探析

【摘要】：数字版权管理是维护版权权利人或持有人在数字版权经济关系中法律权利的终极保护方式。因此,数字版权管理前期设计逻辑主要是先授权使用后监视管理方式,由于效果差强人意,而后数字版权管理开始大量使用连续性不间断监视与管理方式,从而排除非法授权访问与获取资源。进而,数字版权管理同时并列出现两种不同技术方案,延伸为两种截然不同的数字版权管理模式。分析数字版权管理面临的困境,提出划分出两种不同管理模式将成为分析数字版权管理法律问题至关重要的因素。在此基础上,根据相应特点将其称为"柔性数字版权管理"与"刚性数字版权管理",而后分析两种模式在数字版权管理过程中的机制与产生的问题。清晰地分析出两种数字版权管理模式,将对我国数字版权管理中相关法律问题具有重要实践意义。
[Abstract]:Digital rights management is the ultimate way to protect the legal rights of copyright owners or holders in the economic relationship of digital rights. Therefore, the design logic of digital rights management in the early stage is mainly authorization to use after monitoring management mode, because the effect is not satisfactory, then digital rights management began to use a large number of continuous monitoring and management mode. In order to exclude illegal authorization access and access to resources. Furthermore, there are two different technology schemes in digital rights management, which are extended to two different digital rights management models. This paper analyzes the dilemma faced by digital rights management, and points out that dividing two different management modes will be the most important factor in analyzing the legal problems of digital rights management. On this basis, it is called "flexible digital rights management" and "rigid digital rights management" according to the corresponding characteristics. Then, the mechanism and problems of the two models in the process of digital rights management are analyzed. It is of great practical significance to analyze two kinds of digital rights management models clearly, which will be of great practical significance to the related legal problems of digital rights management in China.
