网络环境下著作权的保护与限制

【摘要】：互联网技术发展至今,网络环境下著作权侵权案件层出不穷。与频发的各种互联网著作权侵权案件相比,原有的著作权相关法律已显得落后。本文以网络环境下的著作权保护机制为研究对象,通过对著作权人、网络服务提供者与社会公众之间利益平衡等理论分析,结合“韩寒等作家诉百度文库侵权”纠纷,探讨我国网络著作权保护存在的缺陷和难点,并且结合基本法学原理和司法实践,对完善互联网环境下著作权法律保护机制提出一些建议。本文主要分为五个部分,每个部分的基本内容如下：第一部分为引言,通过对“作家诉百度侵权案”的简单分析引出本文的研究对象：网络环境下著作权的保护和限制。第二部分开始为正文,简述了网络技术发展对著作权保护的影响以及我国网络著作权保护现状。第三部分是对网络环境下著作权保护的缺陷和难点的考察,结合“作家诉百度侵权案”,分析网络著作权保护的几个难点：合理使用与技术保护措施的博弈、网络服务提供者的责任机制、地域管辖的范围等,指出我国立法和司法在网络著作权保护方面都存在一定缺陷。第四部分从学理上分析了网络环境下著作权新的平衡机制,即传统著作权保护中著作权人和社会公众间的利益平衡被互联网技术的出现和发展所打破,网络环境下的著作权制度应当满足著作权人、网络服务提供者和社会公众三方利益的平衡。第五部分是对完善我国网络著作权保护的几点建议,这一部分主要针对上文中提出的一系列问题提出笔者自己的建议,如明确网络服务提供者的责任机制、建立补偿金制度等,以期对完善我国网络环境下著作权保护制度起到一定作用。
[Abstract]:With the development of Internet technology, the case of copyright infringement under the network environment has been emerging. Compared with the frequent Internet copyright infringement cases, the original copyright-related laws have been lagging behind. In this paper, under the network environment, the copyright protection mechanism is the research object, and through the theoretical analysis of the balance of interests between the copyright owner, the network service provider and the public, this paper discusses the defects and difficulties of the network copyright protection in our country by combining the "Han Han and other writers v. Baidu Library Infringement" disputes. And in combination with the basic law principle and the judicial practice, some suggestions are put forward to perfect the copyright law protection mechanism under the internet environment. This paper is divided into five parts, and the basic contents of each part are as follows: the first part is the introduction, and the research object of this paper is drawn out through the simple analysis of the "The writer v. Baidu's case": the protection and limitation of the copyright under the network environment. The second part is the text, the influence of the development of the network technology on the copyright protection and the current situation of the network copyright protection in our country. The third part is to investigate the defects and difficulties of the copyright protection under the network environment, and combine the "The writer v. Baidu's case" and analyze the difficulties of the network copyright protection: the reasonable use of the game with the technical protection measures, the responsibility mechanism of the network service provider, the scope of the regional jurisdiction, etc., It is pointed out that there are some defects in the protection of network copyright in China's legislation and the administration of justice. The fourth part analyzes the new balance mechanism of the copyright under the network environment, that is, the balance between the copyright owner and the public in the traditional copyright protection is broken by the emergence and development of the Internet technology, and the copyright system under the network environment shall meet the copyright owner. The balance of the three-party interests of the network service provider and the public. The fifth part is a few suggestions to improve the protection of the network copyright in our country, and this part puts forward the author's own suggestions for a series of problems, such as the clear network service provider's liability mechanism, the establishment of the compensation system, etc. In ord to play a certain role in that improvement of the copyright protection system in the network environment of our country.
