新生代农民工犯罪问题及其治理对策的比较研究

【摘要】： 当前,城市农民工的群体结构正在发生变化,一批70年代后期出生,80年代受教育的农村年轻人逐渐成为农民工的主体,由于他们的成长经历、受教育程度、对社会的看法和对自身发展的期待都有别于第一代农民工,而成为新生代农民工。面对纷繁绚烂的城市生活,新生代农民工所面临的机遇更多,压力更大,对改变现状的渴望也更加强烈。但是这种高预期受到了现实生活的巨大挑战,一些新生代农民工为了迅速改变现状,不惜铤而走险,走上犯罪道路。新生代农民工犯罪问题已成为当前城市治安稳定的一个重大隐患和亟需解决的问题,这个问题解决不好不仅影响到城市的和谐与发展,任由其恶化甚至有可能引起社会的不稳定。本文运用比较研究的方法,将与新生代农民工有一定相似之处的第一代农民工、城市新生代、西方国家新生代移民选取出来,从犯罪主体的身份特征、犯罪类型、犯罪成因以及防控措施等方面进行比较,既研究相似之处,又探究他们之间的不同,并由此提出治理新生代农民工犯罪问题的对策措施。本文共分四个部分:第一部分对新生代农民工犯罪身份特征进行比较研究;第二部分对新生代农民工犯罪的类型进行比较研究;第三部分对新生代农民工犯罪的成因进行比较研究;第四部分为新生代农民工犯罪问题治理对策的比较研究。
[Abstract]:At present, the group structure of urban migrant workers is changing. A group of rural young people born in the late 1970s and educated in the 1980s have gradually become the main body of migrant workers. As a result of their growing up experience, they have been educated.Different from the first generation of migrant workers, they are different from the first generation of migrant workers and become the new generation of migrant workers.In the face of colorful urban life, the new generation of migrant workers face more opportunities, greater pressure, and a stronger desire to change the status quo.However, this kind of high expectation is challenged by the real life. In order to change the status quo quickly, some new generation of migrant workers are willing to take the risk and go on the road of crime.The criminal problem of the new generation of migrant workers has become a major hidden trouble and urgent problem to be solved for the stability of urban public order. This problem not only affects the harmony and development of the city, but also affects the development of the city.Allowing it to deteriorate may even lead to social instability.This paper uses the method of comparative study to select the first generation of migrant workers who have some similarities with the new generation of migrant workers, the new generation of urban migrants and the new generation of immigrants from western countries, from the identity characteristics of the criminal subject, the type of crime,By comparing the causes of crime and the measures of prevention and control, the author not only studies the similarities, but also probes into the differences between them, and puts forward the countermeasures to deal with the criminal problems of the new generation of migrant workers.This paper is divided into four parts: the first part is a comparative study of the criminal identity characteristics of the new generation of migrant workers, the second part of the new generation of migrant workers crime types of comparative research;The third part is a comparative study on the causes of crimes committed by the new generation of migrant workers, and the fourth part is a comparative study on the countermeasures of the crime management of the new generation of migrant workers.
