侦查学专业教育研究

【摘要】: 现代侦查的出现不过两百多年,1750年出现了世界上第一支现代侦查力量--弓街侦缉队(bow street runners),1893年出版了汉斯·格罗斯的《司法检验官手册》,成为侦查学的诞生标志。早在1829年英国的罗伯特·皮尔爵士在创立伦敦大都市警察时就确立了警察教育的基本制度,而在1842年苏格兰场取代弓街侦缉队后又成立了专门的侦探培训学校,到1936年开始了由仅仅依靠在实践中师傅带徒弟的侦探培养模式转为系统培训侦探模式,侦查人才的培养慢慢步入了现代化、系统化。我国侦查人才的系统培养起步也比较晚,从1979年国家教育部批准设立侦查学专业本科至今也只有近三十年的时间,侦查学专业为我国侦查教研和实务人才的培养作出了巨大贡献。目前侦查学研究不断发展,但关于侦查学专业教育的研究甚少,笔者鼓足勇气尝试对侦查学专业教育进行历史的总结,现实的分析和未来的展望。 侦查学专业教育现实中面临不少现实问题,例如,“现在侦查学专业培养学生的内容脱离实际”,“学生在学校没学到什么东西”等等疑惑,影响着侦查学专业教育发展,由此,,带来了对侦查学专业教育的一些列思考和追问:提出上述问题是提问者思想的偏差还是侦查学专业教育自身的问题?侦查学专业教育如何定位?侦查学专业教育的目标和任务是什么?侦查学专业教育如何拓展自身? 本文分为四章: 第一章绪论,主要说明本文探讨的问题是什么,研究的意义何在,研究方法有哪些。 第二章是关于侦查学专业教育的基础理论。现在高等教育的理念势必影响到侦查学专业教育,分析高等教育的理念有助于明确侦查学专业教育的定位,解释一些对侦查学教育的看法,重点理清两个关系:第一,侦查人才培养与高等教育或者说侦查学专业教育的关系;结论就是侦查人才培养需要高等教育,即侦查学专业教育。第二,侦查学专业教育与警察(公安)教育的关系,这个问题涉及到如何把握侦查学专业教育的模式,结论是侦查学专业教育尽管在专业门类上属于公安类专业,但是与警察(公安)教育存在着交叉关系,侦查学专业是以侦查活动为基点的,而警察(公安)教育是以警察职业为基点。无论是英国还是美国,侦查力量不是天然地和警察一起出现,警察也不是天生就承担打击犯罪的职能,而是随着时代逐步发展,警察才开始承担侦查职能。 第三章是关于我国侦查学专业教育的发展简介,同时还介绍了美国、日本、俄罗斯的侦查人才培养情况。 第四章是对我国侦查学专业教育的框架分析。从培养目标、培养模式、教学方面、师资队伍四个方面对我国侦查学专业教育框架进行剖析。在每个具体内容阐述中,基本的结构是:首先对当前的状况进行分析,然后提出笔者的一些拙见。第一,关于培养目标,主要解决的是我们培养什么样的人才,应当具备什么素质,目前侦查学专业教育的培养目标的细化研究比较薄弱,本文对我国侦查学专业的培养目标作出了对比分析,并拟出了我国侦查人才应当具备的素质。第二,关于培养模式,主要针对现在关于侦查人才的学历教育和职业培训两种教育模式的争论,侦查学专业教育作为侦查人才培养的学历教育而存在,这是有历史和现实依据的。至于学历教育是在普通高等院校还是公安院校进行则是一个需要讨论的问题,笔者赞同侦查学专业教育在普通高等院校开设。第三,关于教学方面,涉及两个问题:教什么?怎么教?教什么就是课程体系、学科内容相关方面,课程体系必须明确,一些研究文献已经有了分析,所以本文只强调两个内容:课程体系设置或课程内容中应当增加方法论的分析工具,能够进行知识再生产,而不仅仅是知识性内容;学科内容必须得到更新。详细分析我国侦查学教学内容面临的两个现实问题。怎么教强调教学手段的多样性。第四,关于师资队伍,本文从教师的选拔、教师的培养等方面论述。 本文的研究内容具有系统性,以前的有关研究都是零星而不全面的,本文第一次对侦查学专业教育的有关问题从理论到实践,从历史到现实作了较全面的阐述,构建一个完整的逻辑体系。在理论深度上,本文一改以前有关研究泛泛而谈、比较肤浅的现象,加强了系统性的理论论证。此外,本文还以问题式导入的阐述和论证,贴近实际。
[Abstract]:The emergence of modern investigation was only more than 200 years. In 1750, the world's first modern investigative force, the Bow Street runners, was created in 1893, and Hans Gross's "Handbook of judicial inspector" was published in 1893 as a sign of the birth of investigative science. In 1829 Sir Robert Pierre was in the founding of Metropolitan Police in London. The basic system of police education was established, and a special detective training school was set up after the Scotland field was replaced by the detection team of Bow Street in 1842. By 1936, the mode of detective training, which only relied on the master and apprentice in practice, was turned into a systematic training detective mode, and the training of investigative talents gradually entered into modernization and systematization. The system training of investigative talents in China is relatively late. From the approval of the State Ministry of education in 1979, it has only been nearly thirty years since the establishment of the specialized undergraduate of investigation science. The investigative specialty has made great contributions to the training of the investigative teaching research and practical talents in our country. Very few, the author plucked up the courage to try to make a historical summary, realistic analysis and future prospects for the professional education of criminal investigation.
There are many practical problems in the reality of the professional education of investigation. For example, "the contents of the students are divorced from the reality" and "the students do not learn anything in the school" and so on, which affect the development of the professional education of the investigation. The problem is the deviation of the thought of the questioner or the problem of the professional education of the investigation. How to locate the professional education of the investigation? What are the objectives and tasks of the professional education of the investigation and how to expand the professional education of the investigation?
This article is divided into four chapters.
The first chapter is the introduction, which mainly explains what the problems are discussed in this paper, what the significance of the research is and what methods to study.
The second chapter is about the basic theory of professional education in investigation. Now the concept of higher education is bound to affect the professional education of investigation. The analysis of the concept of higher education will help to clarify the orientation of the professional education of investigation, explain some views on the investigation education and clarify the two relations. First, the cultivation of investigative talents and higher education. Or the relationship between the investigative professional education; the conclusion is that the training of the investigative talents needs higher education, that is, the professional education of investigation. Second, the relationship between the professional education of investigation and the police (Public Security) education. This question involves how to grasp the mode of the professional education of the investigation, and the conclusion is that the speciality education of the investigative science belongs to the professional category. In the public security class, there is a cross relationship with the police (Public Security) education, the investigative specialty is based on the investigation activities, and the police (Public Security) education is based on the police occupation. With the development of the times, the police began to undertake the investigative function.
The third chapter is about the development of professional education in criminal investigation in China. It also introduces the training of investigators in the United States, Japan and Russia.
The fourth chapter is the analysis of the framework of our country's investigative professional education. From the four aspects of the training target, the training mode, the teaching aspect and the teacher team, we analyze the professional education framework of our country. In each specific content, the basic structure is the analysis of the current situation, and then some of my humble opinions. First, on the training target, the main solution is what kind of talents we should cultivate, what quality should we have, the research on the refinement of the training target of the current investigation specialty education is weak. This paper makes a contrast analysis on the training target of our country's investigative specialty, and draws up the quality of the investigative talents in our country. Second, The training mode is mainly aimed at the debate about the two educational models of the educational and vocational training of the investigative talents. The professional education of investigative science exists as the educational education of the investigative talents, which has the historical and realistic basis. As for the education of academic education in ordinary higher education or public security institutions, it is a need to discuss. On the question, the author agrees that the professional education of investigation is opened in ordinary colleges and universities. Third, on the teaching aspect, there are two questions: what? What? What is the curriculum system, the related aspects of the subject content, the curriculum system must be clear, and some research literature has been analyzed, so this article only emphasizes two contents: Curriculum The system setting or course content should increase the analytical tool of methodology, can carry on the knowledge reproduction, not only the knowledge content; the subject content must be updated. The detailed analysis of the two practical problems in the teaching content of our country's investigation. How to teach the diversity of the hand section of the strong regulation. Fourth, about the teacher team, this article This paper discusses the selection of teachers and the training of teachers.
The research content of this article is systematic, the previous research is fragmentary and not comprehensive. The first time in this paper, the problems related to the professional education of the investigative science, from the theory to the practice, from the history to the reality, are expounded comprehensively, and a complete logical system is constructed. Compared with the superficial phenomenon, the systematic theoretical argumentation is strengthened. In addition, this article also adopts the introduction and demonstration of problem introduction, which is close to reality.
