公平正义视角下L市城市少数民族流动人口问题研究

【摘要】:随着城市化进程的不断加快,越来越多的少数民族人口从民族地区流向城市,他们丰富了城市的文化,壮大了城市的经济,为城市的发展贡献了自己的力量,同时也给城市管理带来了巨大挑战,使城市的稳定和发展面临许多新情况、新问题。由于来自民族自治地方和边远乡村的少数民族农牧民与城市居民在文化传统、生活方式、价值观念、风俗习惯、宗教信仰等方面存在较大差异,少数民族流动人口的权利和机会受到不同程度的限制和忽视,有时得不到尊重和理解,一些侵害少数民族流动人口合法权益的行为也时有所见。随着各民族群众交往活动日益增多,容易引发民族矛盾和冲突。少数民族流动人口已成为影响城市民族关系的重要因素。其中,城市少数民族流动人口的权益保障问题无疑是最核心的内容之一。 本文针对我国当前少数民族流动人口在城市遭受不平等待遇的现实,结合L市的城市少数民族流动人口管理的实际情况,运用罗尔斯的公平正义理论,分析了L市少数民族流动人口问题的现状,归纳出少数民族流动人口管理过程中出现的卫生保健、民族风俗习惯和宗教信仰的实现、子女义务教育、社会保障、就业、社会交往等问题,分析了平等的权利缺失和平等的机会缺失的原因,并提出了对策和建议。 本文认为,做好城市少数民族流动人口管理工作要从管制向服务转变。通过推进公共服务均等化,创造民族平等团结的社会氛围促进环境公平,加大资金投入,扶持民族经济与文化,依托社区管理,建立城市少数民族流动人口服务机制,提高城市少数民族流动人口就业能力,依托少数民族社团,促进民族大团结,保障少数民族流动人口实现平等的机会。通过尊重宪法,依宪行政,唤醒少数民族流动人口的权利意识,保障少数民族流动人口实现平等的权利。逐步适应经济社会发展的新形势新需要,解决民族间事实上不平等的问题,维护城市在利益均衡的社会实现公平与正义。
[Abstract]:With the continuous acceleration of urbanization process, more and more ethnic minority population flow from ethnic areas to cities. They enrich the culture of the city, strengthen the economy of the city, contribute their own strength to the development of the city, and bring great challenges to the urban management, so that the stability and development of the city are faced with many new situations and new questions. The minority farmers and herdsmen from ethnic autonomous areas and remote villages have great differences in cultural traditions, lifestyles, values, customs and religious beliefs, and the rights and opportunities of the ethnic minority floating population are limited and ignored, and sometimes they can not be respected and understood. The act of infringing the legitimate rights and interests of the floating population of ethnic minorities is also seen. With the increasing number of people in various ethnic groups, ethnic contradictions and conflicts are easily triggered. The floating population of ethnic minorities has become an important factor affecting the ethnic relations of the cities. Among them, the protection of the rights and interests of the floating population of the urban minority is undoubtedly the most important One of the contents.
In view of the reality of the unequal treatment of the current minority floating population in the city and the actual situation of the management of the floating population of the urban minority in the city of L, the present situation of the problem of the floating population of the minority nationalities in the city of L is analyzed by Rawls's Theory of fairness and justice, and the emergence of the management process of the floating population of the minority ethnic groups appears in the process of management. Health care, national customs and customs and religious beliefs, children's compulsory education, social security, employment, social communication and other issues, analysis of the reasons for the lack of equal rights and the lack of equal opportunities, and put forward countermeasures and suggestions.
This article holds that the management of the floating population of the ethnic minorities should be changed from the control to the service. By promoting the equalization of public services, creating a social atmosphere of equality and unity, increasing the investment, supporting the national economy and culture, relying on the management of the community and establishing the service mechanism of the floating population of the urban minority. The employment ability of the floating population of the minority nationalities in High City, relying on minority groups, promoting national unity and guaranteeing the equal opportunities for the floating population of ethnic minorities. Through the respect of the constitution, the constitutional administration, awakening the rights consciousness of the floating population of ethnic minorities and guaranteeing the equal rights of the floating population of ethnic minorities. The new situation and new needs of development should solve the problem of de facto inequality among ethnic groups and safeguard the realization of fairness and justice in a balanced society.
