和谐社会建设中群体性事件应对的理论与实践

【摘要】： 《中共中央关于构建社会主义和谐社会若干重大问题的决定》提出,要积极预防和妥善处置人民内部矛盾引发的群体性事件,维护群众利益和社会稳定,统筹协调各方面利益关系,妥善处理社会矛盾。决定要求,要适应我国社会结构和利益格局的发展变化,形成科学有效的利益协调机制、诉求表达机制、矛盾调处机制、权益保障机制。党的十七大提出,要着力解决人民最关心、最直接、最现实的利益问题,努力形成全体人民各尽其能、各得其所而又和谐相处的局面,为发展提供良好社会环境。从构建和谐社会的视野来看,群体性事件的处理是一个非常重要的问题。群体性事件是目前我国社会活动中出现的一些超出现行社会规范的行为,是社会关系中出现的一种不协调、不和谐现象。在社会上造成了一定的危害,影响了社会的稳定,日益成为构建和谐社会的制约因素。因此,如何有效预防和应对群体性事件已成为当前社会必须研究的重大课题。笔者试就加强突发性群体事件的理论研究,掌握突发性群体事件的来龙去脉,如何有效应对好群体事件作一探讨。本文共分四个部分。第一部分分析了群体性事件的概念、发展过程和特征。认为群体性事件是指具有某些共同利益的群体,为了实现某一目的,采取静坐、冲击、游行、集合等方式向党政机关施加压力,破坏公私财物,危害人身安全,扰乱社会秩序的事件。具有多样性、多元性、目的性、策划性和突发性。第二部分着重分析了群体性事件的成因。群体性事件产生主要有根源性、文化、基础性、政治性、体制、启动性等因素。第三部分提出建立全面系统的群体性防范机制。着重阐述了防范机制的目的、内涵和应对预案。第四部分形成科学有效的群体性事件处置机制。全面阐述了处置群体性的基本原则、处置步骤及方法、善后机制、法律对策和政法机关的执法策略等,提出了有针对性的解决措施。
[Abstract]:The "decision of the CPC Central Committee on several important issues concerning the Construction of a harmonious Socialist Society" points out that it is necessary to actively prevent and properly handle mass incidents caused by contradictions among the people, so as to safeguard the interests of the masses and social stability. Coordinate the interests of all parties and properly handle social contradictions. The decision requires that we should adapt to the development and change of our social structure and interest pattern, and form a scientific and effective interest coordination mechanism, a demand expression mechanism, a contradiction mediation mechanism, and an equity protection mechanism. The 17th National Congress of the Communist Party of China proposed that efforts should be made to solve the most concerned, direct and realistic interests of the people, and to strive to form a situation in which all the people can do their best and get along in harmony with each other in order to provide a good social environment for development. From the perspective of building a harmonious society, the handling of group incidents is a very important issue. Group event is a kind of disharmony and disharmony in social relations. It has caused certain harm to the society, affected the social stability, and become the restriction factor of constructing the harmonious society day by day. Therefore, how to effectively prevent and deal with mass incidents has become a major issue that must be studied in the current society. The author tries to strengthen the theoretical research of sudden group events, grasp the background of sudden group events, and how to deal with group events effectively. This paper is divided into four parts. The first part analyzes the concept, development process and characteristics of group events. It is believed that mass incidents refer to groups with certain common interests. In order to achieve a certain purpose, they exert pressure on the party and government organs by means of sit-ins, shocks, processions and rallies, thus undermining public and private property and endangering personal safety. An incident that disturbs the social order. With diversity, purpose, planning and sudden. The second part focuses on the analysis of the causes of mass events. Group events are mainly caused by root, culture, basic, political, institutional, priming and so on. The third part puts forward the establishment of a comprehensive and systematic prevention mechanism. The purpose, connotation and plan of prevention mechanism are expounded emphatically. The fourth part forms a scientific and effective mechanism for dealing with group incidents. This paper comprehensively expounds the basic principles, steps and methods of dealing with the group, the mechanism of rehabilitation, the legal countermeasures and the law enforcement strategies of the political and legal organs, etc., and puts forward some pertinent measures to solve the problems.
