十一届三中全会以来我国户籍制度改革和调整的研究

【摘要】：户籍制度是一项基本的国家行政制度。传统户籍制度是与土地直接联系的，以家庭为本位的人口管理方式。现代户籍制度是国家依法收集、确认、登记公民出生、死亡、亲属关系、法定地址等公民人口基本信息的法律制度，以保障公民在就业、教育、社会福利等方面的权益，以个人为本位的人口管理方式。当代中国的户籍制度已经成为经济社会发展的桎梏，迫切需要进行改革。十一届三中全会以来，随着市场经济对人口流动不断提出新的要求，我国对户籍制度也不断的进行着改革，以便使制度与社会发展相适应。深入探讨改革开放以来党和政府对户籍制度的改革调整及其所面临的问题，，具有重要的理论意义和现实意义。本论文以国家历年来颁布的户籍制度、户籍政策为依据，通过对户籍制度多年来的调整问题进行定量分析，从十一届三中全会前后两个时间段着手，对不同时期户籍制度所起作用进行比较研究，并对户籍制度改革给社会所造成的影响进行了分析。分析中显示：户籍制度的改革对我国市场经济的发展、城镇化建设的完善、收入差距的缩小和社会公平以及城乡一体化都有着极为迫切的意义。而现今户籍制度改革的力度和程度还远远不够，改革的步伐仍需继续深化。论文对我国户籍制度的历史由来和改革调整进程进行了总结，分析其改革的现状，并在对户籍制度改革现状进行研究的基础上，分析了户籍制度改革中存在的诸多问题：从价值定位、法律困境、制度缺陷、户籍一元化和城乡一体化是否同步及其他现实问题等六个方面进行了因素分析。最后提出了户籍制度继续改革的五点建议：打破固有思想，明确改革的目标和原则；有理有据，加快法律健全和制度保障；协调统筹，制度改革与社会发展同步进行；调整管理思路，增加服务机制；与时俱进，与经济社会相适应。
[Abstract]:The household registration system is a basic national administrative system. Traditional household registration system is directly related to land, family-based population management. The modern household registration system is a legal system in which the state collects, confirms, and registers the basic information on the population of citizens, such as birth, death, kinship, legal address, etc., in order to protect citizens' rights and interests in employment, education, social welfare, etc. An individual-based approach to population management. The household registration system in contemporary China has become the shackles of economic and social development, and urgent reform is needed. Since the third Plenary session of the Eleventh Central Committee, with the market economy constantly put forward new requirements for population mobility, our household registration system has been continuously reformed in order to adapt the system to social development. It is of great theoretical and practical significance to probe into the reform and adjustment of the household registration system and the problems faced by the Party and the government since the reform and opening up. Based on the household registration system and the household registration policy promulgated by the state over the years, this paper, through quantitative analysis of the adjustment of the household registration system over the years, starts with two time periods before and after the third Plenary session of the Eleventh Central Committee. This paper makes a comparative study on the functions of the household registration system in different periods, and analyzes the influence of the reform of the household registration system on the society. The analysis shows that the reform of household registration system is of great importance to the development of market economy, the improvement of urbanization, the narrowing of income gap, social equity and the integration of urban and rural areas. At present, the reform of household registration system is not enough, the pace of reform still needs to be deepened. The paper summarizes the history of the household registration system and the process of reform and adjustment, analyzes the current situation of the reform, and on the basis of the research on the status quo of the reform of the household registration system, This paper analyzes the problems existing in the reform of the household registration system, including the value orientation, the legal dilemma, the system defects, the synchronization of the integration of the household registration and the urban and rural areas, and other practical problems. Finally, the paper puts forward five suggestions to continue the reform of the household registration system: break the inherent thought, make clear the goal and principle of the reform, have the reason, speed up the perfection of the law and the system guarantee, coordinate the overall plan, carry on the system reform synchronously with the social development; Adjust management thinking, increase service mechanism; keep pace with the times, and economic and social adaptation.
