上海公安信访制度改革研究

【摘要】： 信访在我国政治制度架构中一直是沟通国家机关与人民群众的制度性渠道,起着平衡社会与国家间信息和回应交换的功能。但随着时代背景的转换以及依法治国目标的提出,需要对信访制度进行必要的反思和重新构建,信访制度已逐渐显现出制度性缺陷,并对法制化进程起着延阻作用。本文首先评述了我国信访体制改革的背景及学界观点,以阐述信访制度的基本法理为基础,重点揭示信访的概念、调整范围、信访人的权利、信访机关的权力、信访的功能以及信访工作先进个人实例介绍。又采用社会学、管理学等学科的成果,分析了我国信访工作现状和机构设置,特别是落足于上海市公安局信访工作现状。指出现行的信访制度在当前社会环境下运行还有诸多不足,进而提出信访制度改革的三种模式:集中统一模式、以点带面的整合模式以及分别改进的分散模式;提出信访制度的改革必须走法制化道路并提出进一步提高信访办理质量的对策措施及建议。最后指出信访制度的改革必须同司法体制的改革相协调,才能从根本上解决现在的问题。
[Abstract]:In the framework of our political system, petition has always been the institutional channel of communication between the state organs and the masses of the people, which plays the function of balancing the information and exchanging responses between the society and the state. However, with the change of the background of the times and the raising of the goal of governing the country according to law, it is necessary to rethink and rebuild the system of petition and visit. The system of letter and visit has gradually revealed its institutional defects and has played a delaying role in the process of legalization. This paper first reviews the background of the reform of the petition system in China and the viewpoints of the academic circles. Based on the elaboration of the basic legal principles of the petition system, this paper focuses on revealing the concept, the scope of adjustment, the rights of the petitioners and the power of the petition authorities. The function of letters and visits and the introduction of advanced personal examples. Based on the achievements of sociology and management, this paper analyzes the present situation of petition work and the establishment of institutions in our country, especially the present situation of petition work in Shanghai Public Security Bureau. It points out that the current petition system has many shortcomings in the current social environment, and then puts forward three modes of the reform of the letter and visit system: centralized and unified mode, the integration mode with a point of view, and the improved dispersion mode; The author points out that the reform of petition system must follow the road of legalization and puts forward some countermeasures and suggestions for further improving the quality of handling letters and visits. Finally, it is pointed out that the reform of the petition system must be coordinated with the reform of the judicial system in order to fundamentally solve the present problems.
