云南省边境地区“三非”人员管理存在的问题及对策研究

【摘要】：云南省地处祖国西南边陲，与越南、老挝、缅甸三国接壤，边境一线民族跨境而居，“一寨两国”、“一家两国”的特殊地理情况随处可见。历史上形成两国边境居民相互通婚、贸易、求医、探访、婚嫁的民间交往关系。改革开放以来，随着口岸的开放和边境贸易的拓展，边民出入境流量也急剧增加，在给边境经济的发展注入了新活力的同时，也带来境外边民“非法入境，非法居留，非法就业”现象严重的突出问题。由非法通婚人员、非法务工人员等各类非法移民构成的“三非”人员，不仅干扰了云南省边境地区正常的出入境秩序，，影响当地社会治安秩序，并由此带来计划生育、土地资源分配、社会稳定等一系列社会问题。由于特殊历史、地理环境因素，加之我国相关立法滞后、法律覆盖面空缺以及地方管理手段落后、人员不足、经费紧张等诸多因素使得云南省边境地区“三非”人员管理工作存在大量难以解决的实际问题，也给我国针对境外人员的管理机制产生严重挑战。本文首先分析了云南省边境地区边境管理的独特性，分析研究云南边境地区“三非”人员管理的问题成因、现状及特点。接着针对目前对边境地区“三非”人员实施管理的现状、存在的问题，并对问题产生的根源进行分析。同时分析国外及国内对相关人员管理经验。最后提出针对云南省边境地区“三非”人员管理的对策及建议。本文针对云南省边境地区“三非”人员特点及管理中存在问题与国内外对非法移民管理、难民管理、非法移民子女社会生活状况等研究理论相结合，对云南省各段边境地区不同的管理手段进行利弊分析，力求将国内外在相关领域研究理论运用到从云南省边境地区“三非”人员管理实践中，努力探索一套更为行之有效的管理方法及手段。同时，通过对国内外难民、非法移民管理的研究，探索对在云南省内长期滞留的大量境外难民及非法移民管理方法。提升政府对边境地区“三非”人员的管理能力。
[Abstract]:Yunnan Province is located in the southwestern border of the motherland, bordering Vietnam, Laos and Myanmar. The frontier nationalities live across the border. The special geographical situation of "one country and two countries" and "one country and two countries" can be seen everywhere. In history, the border residents of the two countries intermarry, trade, seek medical treatment, visit, marry folk relations. Since the reform and opening up, with the opening of ports and the expansion of border trade, the flow of border people entering and leaving the country has increased sharply. While injecting new vitality into the development of the border economy, it has also brought about "illegal entry and illegal residence of border people from abroad." Illegal employment "is a serious and prominent problem." The "three illegitimate" personnel made up of illegal immigrants, such as illegal intermarriage personnel and illegal migrant workers, not only interfere with the normal order of entry and exit in the border areas of Yunnan Province, but also affect the order of local public order and bring about family planning. Land resources distribution, social stability and a series of social problems. Due to the special history, geographical environment factors, the lag of the relevant legislation in our country, the lack of legal coverage, the backward local management methods and the shortage of personnel, Many factors, such as shortage of funds, make the management of the "three Africa" personnel in the border area of Yunnan Province have a lot of practical problems which are difficult to solve, and also bring serious challenges to the management mechanism of our country's foreign personnel. This paper first analyzes the unique characteristics of border management in Yunnan border area, and analyzes the causes, present situation and characteristics of the "three non-personnel" management problems in Yunnan border area. Then, this paper analyzes the current situation and existing problems of the management of the "three non" personnel in the border areas, and analyzes the root causes of the problems. At the same time analysis of foreign and domestic related personnel management experience. Finally, the countermeasures and suggestions for personnel management in Yunnan border area are put forward. This paper combines the characteristics and problems of the "three illegitimate" personnel in the border area of Yunnan Province with the theories of illegal immigration management, refugee management, and the social life status of the children of illegal immigrants at home and abroad. This paper analyzes the advantages and disadvantages of different management methods in the border areas of Yunnan Province, and tries to apply the domestic and foreign research theories in the relevant fields to the management practice of the "three non" personnel in the border areas of Yunnan Province. Try to explore a set of more effective management methods and means. At the same time, through the research on the management of refugees and illegal immigrants at home and abroad, this paper explores the management methods of a large number of foreign refugees and illegal immigrants who have been staying in Yunnan Province for a long time. Improve the government's ability to manage the "three Africa" personnel in the border areas.
