浅析女性犯罪人由被害到犯罪的“恶逆变”

【摘要】：女性犯罪中 ,有相当一部分犯罪人具有从被害人到犯罪人转变的过程 ,即女性犯罪的“恶逆变”。女性犯罪“恶逆变”在暴力犯罪和性犯罪中比较突出 ,所侵害的对象具有特定性。女性犯罪“恶逆变”的发生是一个犯罪动机形成的过程 ,其直接动因是 :消极的不良情绪的长期积累 ,为泄愤导致“恶逆变” ;急于摆脱当前不幸处境 ,以恶抗恶 ,导致“恶逆变”的发生 ;对人生的绝望 ,导致“恶逆变”。女性犯罪“恶逆变”与犯罪主体的消极心理密切相关。要预防女性犯罪“恶逆变” ,须加强社会主义精神文明建设 ,创造良好的家庭氛围和社区环境 ;加强基层组织建设 ,充分发挥其预防犯罪的作用 ;各级司法部门要及时、严厉打击家庭暴力犯罪 ,运用法律手段预防女性犯罪 ;家庭成员之间应建立起平等和睦的关系 ,营造良好的家庭氛围 ;女性要注意提高自身素质 ,自强自立。
[Abstract]:In female crime, a considerable number of offenders have the process of changing from victim to criminal, that is, female crime. Female crime is more prominent in violent crime and sexual crime, and the target is specific. The occurrence of female crime "evil inversion" is a process of criminal motive formation, its direct motive is: the long-term accumulation of negative bad emotion, causes "evil inversion" in order to express indignation; Eager to get rid of the current unfortunate situation, to resist evil, leading to the occurrence of "evil inversion", despair of life, leading to "evil reverse change." Female crime is closely related to the negative psychology of the subject of crime. In order to prevent female crime from becoming evil, we must strengthen the construction of socialist spiritual civilization, create a good family atmosphere and community environment, strengthen the construction of grass-roots organizations and give full play to their role in crime prevention. The judicial departments at all levels should promptly and severely crack down on crimes of domestic violence and use legal means to prevent crimes committed by women, and establish equal and harmonious relations among family members to create a good family atmosphere; Women should pay attention to improving their own quality, self-reliance.
