交通事故引致型群体性事件的治理研究

【摘要】:伴随着车辆保有量的增多以及民众出行需求的不断增加,交通事故发生的概率也越来越大,而因事故引发的纠纷和矛盾所产生的社会影响力也呈现出不断加强的态势,,不断增多的交通事故以及交群事件,也成为近年来一直困绕着基层交通管理部门的难题。其实,面对这样新情况,交通管理部门同样在努力进行自我调整。不过,受制于自身能力的不足以及各种客观环境的影响,其对此类事件的治理能力还存在较多的问题,使得交群事件有了一定的发展空间。 为此,本研究的目的就在于分析转型期交通管理部门的工作特别是对交群事件管理过程中存在的问题并寻找相应的对策,从而提升交通管理部门的管理效率,消除交群事件的不利影响。 首先,对治理理论、群体事件理论进行回顾,为本研究的进行奠定理论指导基础,并在此基础上分析了交群事件中多用违法手段表达个人诉求、持续性与反复性并存、参与主体的复杂性的基本特征和社会敏感性增强、模逐渐扩大、情绪与行为的激化、协调难度增加的发展趋势。 其次,以相关的实际案例为支撑分析当前交通管理部门在应对交群事件过程中遇到的事故应对的能力受限、执法对象的扩大化、多因素影响执法标准、脸谱化困境、执法能力的缺陷等问题,这些问题综合在一起给交管工作造成了极大的压力,专业执法管理能力被削弱。与此同时,在分析问题的基础上深入探寻了引起这些困境的主要原因,包括民众对政府部门的不信任,“缺乏信任”的持续性影响,组织内因素固化,交管工作法律滞后、宣传低效,少数交警综合素质不高。 最后,要突破交通管理部门在处理交通事故、应对群体性事件中所面临的问题,需要从以下几个方面进行努力:培育公信力、建立预警机制、提高法律的制约效力、部门自身的转型与再调整、强化权力沟通与横向执法。
[Abstract]:With the increase of vehicle ownership and the increasing of people's travel demand, the probability of traffic accidents is also increasing, and the social influence caused by the disputes and contradictions caused by accidents is also showing a situation of increasing. The increasing number of traffic accidents and traffic accidents has become a difficult problem for traffic management departments at the grass-roots level in recent years. In fact, in the face of such a new situation, traffic management departments are also trying to self-adjustment. However, due to the deficiency of its own ability and the influence of various objective circumstances, there are still many problems in its ability to govern such events, which makes the cross-group events have a certain space for development. Therefore, the purpose of this study is to analyze the problems existing in the traffic management department in the period of transition, especially in the process of traffic group incident management, and to find corresponding countermeasures to improve the management efficiency of traffic management department. Eliminate the adverse effects of cross group events. First of all, the governance theory and group event theory are reviewed to lay a theoretical foundation for this study, and on this basis, the author analyzes the multiple illegal means used to express personal demands, persistence and repetition co-exist. The basic characteristics of the participants' complexity and social sensitivity, the expansion of the model, the aggravation of emotion and behavior, and the increasing difficulty of coordination. Secondly, taking relevant actual cases as the support to analyze the current traffic management departments in the process of dealing with cross-group incidents encountered in the accident response capacity is limited, the law enforcement object expansion, multi-factor impact on law enforcement standards, Facebook dilemma, The defects of law enforcement ability, which put great pressure on traffic management, weaken the ability of professional law enforcement management. At the same time, on the basis of the analysis of the problems, this paper explores the main causes of these difficulties, including people's distrust of government departments, the persistent influence of "lack of trust", the solidification of internal factors, and the lag of the law of traffic management. Propaganda is inefficient, a small number of traffic police comprehensive quality is not high. Finally, in order to break through the problems that traffic management departments face in dealing with traffic accidents and mass incidents, we need to make efforts in the following aspects: cultivating public trust, establishing early warning mechanism, improving the effectiveness of laws. The department's own transformation and readjustment, strengthen power communication and horizontal law enforcement.
