我国辅警制度研究

【摘要】：辅助警力,是指协助国家警察维护社会治安的一支社会力量。我国现代的辅警制度虽然不够发达,但其发展历史却渊源流长。早在秦时期,就有了“里正”这一由民间推举的负责治安的官吏,这是我国辅助警力发展的雏形。到了宋、明、清时期,辅助警力的种类趋于多样化,但主要以保甲制度为主。我国古代辅警既是维护社会治安秩序的一支重要力量,更是封建统治阶级维护其自身统治、加强对人民控制的工具。辅助警力与公安机关同为社会治安防控体系中的重要主体,其工作目标都是为了维护社会治安的稳定。作为公安机关最重要的助手,辅助警力在加强公安基础工作的同时,充分发挥其自身所具有的市场性,从事公安机关不能为的治安防范任务。一方面,建立打防结合的社会公共安全防范系统和当前社会治安形势的发展要求我国建立现代辅警制度;另一方面,辅助警力在缓解警力不足、节约行政成本、提高我国目前的就业率等方面所发挥的作用,是我国建立现代辅警制度的现实依据。我国目前的辅助警力分为治安联防队、治保会、单位保卫组织、交通协管员、专业保安人员等五大类,不同种类的辅助警力在实际运作中存在不同的问题,我国传统的辅警模式已不能适应形势所需。随着中国法制化的进程,以及在公安机关日益强调规范执法的形势下,辅助警力游离于规范化之外,将会严重影响到辅助警力的发展甚至生存,并且也会最终影响到公安机关维护社会治安的警务效率。加快对辅警制度的立法进程;整合辅警资源,建立专业化辅警队伍;加强辅警内部组织模式
[Abstract]:Auxiliary police force refers to a social force that assists the national police in maintaining public order. Although our country's modern auxiliary police system is not developed, its development history is long. As early as Qin Dynasty, there was "Li Zheng", the official in charge of public security, which was the embryonic form of the development of auxiliary police force in China. In Song, Ming and Qing dynasties, the types of auxiliary police tended to be diversified, but the main system was Baojia. In ancient China, auxiliary police were not only an important force to maintain public order, but also a tool for the feudal ruling class to maintain its own rule and strengthen its control over the people. The auxiliary police force and the public security organ are both important subjects in the system of social security prevention and control, and their working objectives are to maintain the stability of social security. As the most important assistant to the public security organs, auxiliary police forces, while strengthening the basic work of public security, give full play to their own market nature, engaged in the public security organs can not be for the task of public security prevention. On the one hand, it is necessary to establish the modern auxiliary police system in our country to establish the social public security prevention system and the development of the current social security situation. On the other hand, the role of auxiliary police force in alleviating the shortage of police force, saving the administrative cost and increasing the employment rate of our country is the realistic basis of establishing the modern auxiliary police force system in our country. At present, the auxiliary police forces in our country are divided into five categories: public security joint defence team, administrative protection committee, unit security organization, traffic warden, professional security personnel, and so on. Different types of auxiliary police forces have different problems in actual operation. The traditional auxiliary police mode in our country can no longer meet the needs of the situation. With the process of legalization in China, and under the situation that the public security organs are increasingly emphasizing the standardization of law enforcement, the auxiliary police forces will seriously affect the development and even survival of the auxiliary police forces. And also will affect the public security organs to maintain public order policing efficiency. Speed up the legislative process of Auxiliary Police system; integrate Auxiliary Police Resources, set up specialized Auxiliary Police Force; strengthen Auxiliary Police Internal Organization Model
