我国有组织犯罪研究

【摘要】： 有组织犯罪是一种极其严重的犯罪，其活动和危害已远远超出了 一个国家的范围，对社会具有巨大的危害性和整体冲击性，因而已成 为世界各国立法、司法机关和刑法理论研究者共同关注的热点问题。 本文系统研究了中外学者对有组织犯罪概念的不同观点，并提出了自 己对于有组织犯罪基本认识与观点，深入浅出地分析了有组织犯罪的 六种不同类型。同时还对有组织犯罪的四大基本特征进行了阐述，并 从政治、经济、社会、心理等方面分析了有组织犯罪产生的原因。着 重阐述了有组织犯罪的惩治和预防，为有效打击有组织犯罪，须建立 专门的惩治机构，完善刑事立法，完善惩治根据。治标更要治本，对 有组织犯罪，，不仅要有效打击，更要重在预防，本文从宏观、微观两 方面试着提出有组织犯罪的预防措施。另外，更要加强国际合作，通 过世界各国的通力合作，共同打击和预防有组织犯罪。
[Abstract]:Organized crime is an extremely serious crime, and its activities and harm have gone far beyond the scope of one country and have great harmfulness and overall impact on society, As a result, it has become a hot issue of legislation, judicial organs and criminal law theory researchers all over the world. This paper systematically studies the different views of Chinese and foreign scholars on the concept of organized crime, and puts forward the basic understanding and viewpoint of organized crime. Six different types of organized crime are analyzed in detail. At the same time, it expounds the four basic characteristics of organized crime, and analyzes the causes of organized crime from the aspects of politics, economy, society, psychology and so on. In order to effectively combat organized crime, it is necessary to set up special punishment institutions, perfect criminal legislation and perfect the basis of punishment. To deal with the symptoms, we should not only effectively crack down on organized crime, but also focus on prevention. This paper tries to put forward the preventive measures of organized crime from macro and micro aspects. In addition, it is necessary to strengthen international cooperation and to work together to combat and prevent organized crime through the concerted efforts of all countries in the world.
