我国消防监督管理制度改革初探

【摘要】:人类用火的实践证明,火既可以服从于人们的意志,造福于人类,火也会违背人们的意愿,给人类带来极大的灾难,为了人类自身的安全,就必须加强对火的控制,有效地同火灾作斗争,这样,,消防管理就随着社会的发展应运而生。当前,世界各国都在努力探索预防火灾发生的有效途径,积极研究适应社会、经济发展需求的消防管理方法。我国在计划经济时期形成的消防监督管理制度现在已经无法满足市场经济发展和加入WTO的需要,城市消防安全工作滞后于城市发展和火灾事故频发的现状,给城市消防安全工作提出了新的要求,我们必须探索出一套适应我国国情的消防监督管理制度。 本文介绍了我国现行消防监督管理制度的形成和现状,结合实际工作,认为现行消防监督管理制度存在以下问题:《消防法》不完善、消防法律体系不能适应市场经济和加入WTO的要求、技术规范混乱并滞后于经济的发展、消防机构职能越位、各级消防监督机构权责混乱、消防监督人员数量少,素质低。通过分析这些问题产生的原因,借鉴发达国家的成功经验,提出消防监督制度改革应采取以下方法:建立健全消防法律法规体系、改变消防监督管理的模式和范围、建立适应国情的消防职业化队伍和消防教育模式。
[Abstract]:The practice of human using fire has proved that fire can not only obey the will of people, benefit mankind, but also bring great disaster to mankind against people's will. For the sake of human safety, it is necessary to strengthen the control of fire. Effectively fight against the fire, so that the fire management along with the development of the society came into being. At present, countries all over the world are trying to explore effective ways to prevent fire occurrence, and actively study fire management methods to meet the needs of social and economic development. The fire-fighting supervision and management system formed in the period of planned economy in our country has been unable to meet the needs of the development of market economy and the entry into WTO, and the work of urban fire safety lags behind the current situation of urban development and frequent fire accidents. New requirements have been put forward for urban fire safety work. We must explore a set of fire control supervision and management system which adapts to the national conditions of our country. This paper introduces the formation and present situation of the current fire-fighting supervision and management system in China. Combining with the actual work, the author thinks that the existing fire-fighting supervision and management system has the following problems: the fire-fighting law is not perfect, The fire-fighting legal system can not meet the requirements of market economy and entry into WTO. The technical norms are chaotic and lag behind the development of economy. The functions of fire-fighting institutions are offside, the powers and responsibilities of fire-fighting supervision organizations at all levels are confused, the number of fire-fighting supervisors is small and the quality is low. By analyzing the causes of these problems and drawing lessons from the successful experiences of developed countries, this paper puts forward the following methods should be adopted in the reform of fire control supervision system: to establish and perfect the fire protection laws and regulations system, and to change the mode and scope of fire control supervision and management. To establish a fire professional team and fire education model adapted to the national conditions.
