我国基层公安机关面临的问题及对策研究

【摘要】：我国的基层公安机关是指依法建立的承担维护国家安全、维护社会治安秩序、保护公民的人身安全、人身自由和合法财产、保护公共财产，预防制止和惩治犯罪活动职能和任务的国家基层行政机关。是基层人民警察机关。是我国人民民主专政政权中具有武装性质的治安行政和刑事司法的基层机关。它具有民主与专政两项基本职能。从这个基层公安机关的概念中我们可以看到，我国基层公安机关是我国人民民主专政的重要工具之一，是国家政权的重要组成部分；是武装性质的国家治安行政力量。基层公安机关本身的属性决定了基层公安机关在新的历史时期应承担重大的历史责任，发挥重大的历史作用：保卫社会主义制度；维护社会治安和公共秩序，确保社会稳定；保护国家公共财产和人民的合法财产；保护公民的人身自由和安全；保障依法治国方略的落实。 回顾基层公安机关曾经走过的历程，我们不难看到，基层公安机关为新中国建立和建设做出了巨大贡献。改革开放以后，我国基层公安机关迅速发展，队伍不断壮大，人数不断增多。现在，随着中国改革开放的深入和中国市场经济体制的逐步确立，我国基层公安机关在队伍建设方面暴露出了许多问题，其主要问题是；违法违纪现象严重；干警总体素质不高；公安管理职权范围界定不清；执法保障不力。这些问题的存在已严重地影响了基层公安队伍的革命化、正规化、现代化、军事化建设；影响了党和政府各项方针，政策的落实；影响了社会主义现代化建设。如果我们听任这些问题发展蔓延，不管不问，就会破坏基层公安工作赖以生存的警民关系，毁坏公安战线广大民警用鲜血和生命赢得的荣誉，从而损害党和政府在人民群众中的形象，最终毁掉整个公安队伍，危害到国家政权。 我国基层公安机关出现以上问题的原因主要是：教育滞后；监督不力；人事管理制度不完善；管理体制不够完善；地方财政保证不力。在找出基层公安 ／Hh （’～一一” ＼、．＿。－＿＿ ＼／。。“ 机关出现问题的原因并加以剖析时，我们可以发现，基层公安机关出现问题的 原因，既有历史的，也有现时的；既有主观的，，也有客观的。因此，我们在研 究制定相应对策的时候，要着眼于基层公安机关的整体。要用发展的眼光， 实事求是的态度，深层次地看待问题，力求根治。 依据基层公安机关所面临的问题找出原因不是目的，目的是根据原因制定 出根治对策，使基层公安机关从根本上摆脱不利因素，健康向前发展。就我国 基层公安机关现在所面临的问题，要从根本上解决，必须要按照以下几个方面 去做：强化教育，提高素质；进一步理顺公安机关的管理体制；健全与完善公 安机关的人事管理制度；加强基层公安机关的内部监督与外部监督；努力改善 基层公安机关的保障系统。
