我国当代女性犯罪社会诱因浅析

【摘要】： 女性犯罪是当今社会不容忽视的一个重要问题,不但给众多家庭造成了悲剧,而且对社会的危害程度日趋严重,已经成为影响经济发展、社会稳定的不可忽视的因素,应当引起高度重视。面对当前中国社会女性犯罪不断上升和蔓延的态势,关于女性犯罪的原因探讨已成为一个受到广泛关注的热点。本文从社会性别视角出发,在相关法学理论的指导下,通过文献检索和实地研究,运用问卷调查和个案访谈相结合的方法,对社会转型期女性犯罪进行分析,探讨女性犯罪的社会原因,力求突破一些传统的看法,澄清一些认识上的误区,改变以往把女性自身素质作为导致女性犯罪的根源的观念。 本文分三个部分五个章节进行论述。 第一部分是前言部分。界定了女性犯罪的一般概念、当今女性违法犯罪现状、以及国内外犯罪学家和社会学家对女性这一特殊犯罪群体的犯罪原因的研究概况,指出女性犯罪原因与男性犯罪相比,有一定的特殊性,应引起特别的重视,并应当将其置于社会大背景中予以研究。 第二部分分四个章节,从社会体制、社会角色、社会文化、婚姻家庭四个方面深入剖析导致女性犯罪的社会诱因,揭示女性犯罪问题背后的资源不平等及性别不平等问题,综合地分析诱导女性犯罪的社会因素。 第一章“我国社会体制转型对女性犯罪的诱因分析”。从社会体制角度分析论证了我国体制转型对诱导女性犯罪产生的影响。社会大规模的流动减弱了职能部门对流动女性的控制力,流动女性又很难适应新的社会环境,迫于生计,流动女性犯罪现象便大量滋生。另外,市场经济大发展的同时,也带来了一定的负面影响,如拜金主义盛行、女性就业难、经济地位低等问题都进一步诱发了女性心态的失衡,导致女性违法犯罪升级。 第二章“我国当代女性犯罪诱因的社会角色分析”。从新时期女性社会角色发生变迁这一角度入手,论证了社会转型时期,随着女性与社会接触越来越频繁、对社会角色的参与越来越多,女性产生了难以克服的角色失调现象,社会角色冲突、社会角色不清、社会角色中断、社会角色失败等问题使越来越多的女性产生困惑。在各种因素刺激下,自制力较差的女性便容易产生社会越轨行为的冲动性,诱发犯罪。 第三章“我国当代女性犯罪诱因的社会文化因素分析”。论证了社会文化因素对女性犯罪的重要影响。分三个层次进行分析:首先,随着当今多元化的文化观念不断冲击女性的思想领域,文化观念冲突不断加剧,女性的婚姻家庭观念、性观念无不受到强烈的震荡,产生巨大变迁。其次,我国几千年的封建家庭伦理观念、具有性别歧视的社会文化传统至今影响着女性在家庭和社会中的地位。再次,社会对女性同情怜悯的刻板心理无形间放纵了女性违法犯罪者。这些文化因素在不同条件的作用下,都在不同程度上成为诱导女性走上犯罪道路的催化剂。 第四章“女性犯罪诱因的婚姻家庭背景分析”。从婚姻家庭背景角度分析女性犯罪的诱因。婚姻家庭因素是诱导女性犯罪的最重要因素。其中着重论证了家庭暴力对女性暴力犯罪的重大影响。笔者在此多着笔墨详细分析了家庭暴力的社会现状、引起的社会后果以及其背后隐藏的社会原因,力求透彻分析家庭暴力行为深刻的社会背景,从而找到受虐女性“以暴制暴”犯罪的根源。同时,婚姻和感情危机、狭隘的家庭亲情也容易使女性丧失理智,最终导致其行为失范。 第五章“女性犯罪的法律控制与社会预防机制”。针对以上分析论证的诱导女性犯罪的社会原因,笔者提出了粗浅的建议。从加强对女性法律权益的保护、构建反家庭暴力的法律环境、实现社会全方位的预防控制三方面入手,建议在加大立法、司法、执法力度的同时,不断健全调解组织、妇联组织、社会治安综合治理机构等基层组织,以便形成强大的社会网络,建立起科学的、切实可行的控制机制,力求将女性犯罪扼杀于萌芽之中。 第三部分是结语部分。简要阐述了本文的研究目的,以及以犯罪学和社会学的一般理论与女性自身特点紧密结合的研究特色,并特别强调了在社会学视野下研究女性犯罪诱因的必要性。从而呼吁有关学者加强对女性犯罪这一边缘学科的重视。
