欧洲一体化进程中的移民政策研究

【摘要】： 本论文是关于欧洲一体化进程中移民政策发展的理论与实践的探讨。欧共体／欧盟移民政策的发展，不仅表现在国家层面符合成员国国情的发展，还表现在超国家层面的协调与合作，而且这两个层面都离不开欧洲一体化这一最重要的历史背景。论文通过历史分析、比较研究欧共体／欧盟移民政策制定的历史背景、制约政策形成的复杂因素、政策主要内容及历史脉络、政策作用影响等，揭示出移民政策的内在机制和发展趋势。本论文正文共分七章，加上前言和结论共有九个部分。在前言中，主要阐述了选题的现实意义，评介了国内外有关欧洲移民政策研究的学术动态，并提出了通过本文的研究工作希望达到的两个目标。第一章，移民概念和移民政策的理论界定。阐明了移民的定义和移民的类型，并对移民政策范畴进行了全面阐释。在理论概念上的界定，主要为后面的研究确立规范的基础。第二章，欧盟移民流向的动因分析。首先对各种派别的国际移民动因理论进行了评介，随后应用“推—拉”理论全面地分析了东部、南部两股移民流形成的动因。第三章，欧盟移民控制政策。论述了移民控制的政策基础，，分析了移民政策控制的外部控制和内部控制及其特点。在论述移民控制制度化时，着重论述了出入境签证制度和居留就业许可管理制度。阐述了移民控制条件以及反控制问题。第四章，移民融合政策分析。论述了移民融合的概念，各成员国对待移民融合的共识，以及归化入籍政策。从历史与现实分析了移民被排斥的境况。分析论述了欧盟成员国移民政策融合的三大代表性模式即差异排斥模式、共和模式、多元文化模式。第五章，移民输入国与移出国政策协调。阐发了移民系统理论，并对输入国与输出国政策协调的纽带移民链系进行了条分楼析的阐述，集中概括了移民输入国与输出国政策合作领域以及特点。第六章，德、法、英国别移民政策比较。从历史的纵向发展阐述了征募劳工时期、限制性移民政策发展中，德、法、英三国移民政策发展，并通过分析比较阐述了各国的政策发展异同，揭示出各自政策的内在实质。第七章，欧洲一体化进程中的移民政策发展。以欧洲一体化的历史变迁为背景，分析了移民状况以及欧共体／欧盟层面移民政策变化。着重论述了20世纪80年中期以来欧洲移民政策治理三个主要策略《申根协定》、《都柏林公约》、《边境公约》。分析了随着一体化的深入扩展移民政策决策机制的发展。详细论述了统一意识与联盟公民的形成发展，认为统一意识、联盟公民是欧盟移民政治的核心，目前联盟公民权不能脱离国家公民权而独立存在，它只在有限的范围内发挥一定的作用，联盟公民概念应随着一体化的深入而发展。结语：欧盟移民政策展望。为全文的概括并对欧盟移民政策发展进行了前瞻性论述，分析了影响欧盟迈向统一移民政策进程的制约性因素，认为欧盟至2004年将制定的统一移民政策并非一揽子解决移民问题的全面政策，很大程度上将局限于移民控制政策范畴的统一，至于移民融合政策的协调统一，由于涉及成员国国家主权让渡，与各国国家利益切实关联，很难达成关键性成果。从长远来看，欧盟移民政策的发展和欧盟建设总体目标是密切相关的，欧洲一体化发展方向决定着欧盟共同移民政策的统一程度。
[Abstract]:This thesis is about the theory and practice of immigration policy development in the process of European integration. The development of EC/ EU immigration policy reflects not only the development of the country's national conditions but also the coordination and cooperation at the supranational level, but also the most important historical background of European integration.
