论美国“敏感信息”管理改革及其对我国的启示

【摘要】：在美国,"国家秘密"和"敏感信息"都属于依法不公开信息,后者指虽然不符合定密标准但一旦公开却可能会造成损害或潜在损害的信息。"9.11"事件发生后,小布什政府高度重视"敏感信息"保护,全面提升美国"敏感信息"保护政策。但是"重保护、轻规范"却导致"敏感信息"管理的混乱。因此,奥巴马政府上台之后,对"敏感信息"管理制度进行了一系列改革,取得了显著效果。其中一些有益的经验值得我国借鉴。
[Abstract]:In the United States, "national secrets" and "sensitive information" are non-disclosure information according to law, which refers to information that may cause damage or potential damage once it is made public, although it does not meet the established confidentiality criteria. After the "9 / 11" incident, The Bush administration attaches great importance to the protection of "sensitive information" and promotes the policy of protecting "sensitive information" in an all-round way. However, "protect lightly" leads to confusion in the management of "sensitive information". As a result, the Obama administration has carried out a series of reforms to the "sensitive information" management system, which has achieved remarkable results. Some of the useful experiences are worthy of our reference.
