现实与超越:马克思正义理论的辩证结构

【摘要】：正义的现实性与超越性是马克思正义观念的两个不同位阶,后者是一个既批判又涵盖前者的概念,二者既是逻辑相连的又是历史连续的,共同构成了马克思正义理论的辩证结构。现实性正义与超越性正义分别是资本主义社会和共产主义社会占主流地位的正义形态,只有当历史发展从资本主义社会过渡到共产主义社会时,才可能从现实性正义过渡到超越性正义。现实性正义内蕴着两个性质截然相反的形态:交换领域的形式性正义和生产领域的实质性非正义;超越性正义内蕴着两个历史相续的正义原则,即贡献原则和需要原则。马克思正义理论的确立离不开作为世界观的历史唯物主义,历史唯物主义的创立为思考正义问题提供了新的方法论原则,即历史原则。
[Abstract]:The reality and transcendence of justice are two different levels of Marx's concept of justice. The latter is a concept that both criticizes and covers the former. Together constitute the dialectical structure of Marx's theory of justice. Realistic justice and transcendental justice are the main forms of justice in capitalist society and communist society respectively. Only when the historical development from capitalist society to communist society, It is possible to transition from realistic justice to transcendental justice. Realistic justice contains two opposite forms: formal justice in the field of exchange and substantive injustice in the field of production, and transcendental justice contains two historical principles of justice, namely, the principle of contribution and the principle of need. The establishment of Marx's theory of justice can not be separated from historical materialism as a world outlook. The establishment of historical materialism provides a new methodological principle for thinking about the problem of justice, that is, historical principle.
