新型跨国暴力冲突结构、武装无人机与国际战争规范的进化

【摘要】：冷战结束以来,跨国暴力冲突结构发生了新变化。国家行为体之间的暴力冲突虽然仍在发生,但数量逐渐递减;而国家行为体与恐怖组织这类非国家行为体之间的跨国暴力冲突的数量持续上升,已成为国际暴力冲突的重要形式。新型跨国暴力冲突的突出特点就是不对称性。在此背景下,规约国家行为体之间暴力冲突行为的既有国际战争规范面临挑战,存在进化的必要性。尽管武装无人机的使用给予国家行为体应对恐怖主义威胁的"相称"能力、强化了新型跨国暴力冲突结构的不对称性特点、延长和再造了新型跨国暴力冲突结构,但其并不会直接引发既有国际战争规范的进化;只有新型跨国暴力冲突结构的形成才是引发既有国际战争规范进化的根本原因。
[Abstract]:Since the end of the Cold War, new changes have taken place in the structure of transnational violent conflicts.While the number of violent conflicts between State actors continues to decline, the number of transnational violent conflicts between State actors and non-State actors such as terrorist organizations continues to rise,It has become an important form of international violent conflict.The striking feature of a new type of transnational violent conflict is asymmetry.In this context, the existing international war norms governing violent conflict among state actors face challenges and the necessity of evolution.Although the use of armed drones gives State actors the "proportionate" capacity to respond to the threat of terrorism, reinforces the asymmetrical character of the new structures of transnational violent conflict and prolongs and recreates new types of structures of transnational violent conflict,However, it does not directly lead to the evolution of the existing norms of international war; only the formation of a new structure of transnational violent conflict is the fundamental reason for the evolution of the existing norms of international war.
