一衣带水之中岂有无主之岛

【摘要】：考量钓鱼岛的领有权问题,不仅要适用现代国际法,更要适用古代亚洲国际法。日本政府"确认"钓鱼岛"无人""无主"耗时十年时间,那样一种漫长的"确认"过程,恰好证明当时的日本政府知道钓鱼岛是有主的。钓鱼岛在中国近海,在东亚内海,与大洋中心地带的岛屿不能适用同样的国际法。
[Abstract]:Considering the sovereignty of Diaoyu Island, it is necessary not only to apply modern international law, but also to apply ancient Asian international law.It took a decade for the Japanese government to confirm that the Diaoyu Islands were uninhabited, and that the long process of "confirmation" proved that the Japanese government knew that the Diaoyu Islands were owned.The Diaoyu Islands are not subject to the same international law as the islands in the heart of the ocean, off the coast of China and in the inner seas of East Asia.
