【摘要】：对恐怖主义的法律对策研究是近年来我国法学界的一个热点问题。基于各种学科背景,学界已产生了较为丰硕的研究成果,但是还有很多理论的空白区。本文立足于前沿的学术成果,对“反恐怖主义法律对策”这样一个学术焦点问题作出了初步的思考与探讨,以期对丰富中国反恐怖主义的法律理论研究,适应中国国开展反恐怖主义斗争的现实需要,维护国家安全和社会公共秩序服务等方面作出一点成绩。论文的基本思路是在澄清对恐怖主义基本认识的基础上,阐述了西方主要国家的反恐怖主义法制经验,分析了中国反恐怖主义立法现状,从而提出完善中国反恐怖主义法律屏障的构想和对策。论文主体分四大部分。第一部分是“恐怖主义概述”。就如何正确认识恐怖主义需要把握的几个关键点作出了精要的阐述。包括恐怖主义的定义及其特征,恐怖主义发生的社会根源,政治背景,当代恐怖主义的发展趋势等。通过这几个层面的梳理与分析,为反恐怖主义法律对策的提出提供一个逻辑支撑。第二部分是“西方主要国家的反恐怖法制经验”。列举了美国、俄罗斯、英国、德国四个西方国家应对反恐怖主义活动的立法经验,对论文的第三部分作出参照和铺垫。第三部分是“中国反恐怖主义法律体系的完善”。指出完善中国反恐怖主义立法的必要性,同时分析列举了现有的散见于各个部门法中的反恐怖主义立法现状,并就完善中国反恐怖主义立法做了具体的分析。结语部分指出,反恐怖主义活动紧紧依靠法律对策是不够的,其根本途径还在于社会的综合治理,从形成恐怖主义基础的民族、宗教、文化、教育等各个面向出发,建立健全一套协调有效的社会政策机制,是解决恐怖主义问题的根本之道。
[Abstract]:In recent years, the research on the legal countermeasures of terrorism is a hot issue in the field of law in our country. Based on the background of various disciplines, academic circles have produced abundant research results, but there are still many theoretical gaps. Based on the advanced academic achievements, this paper makes a preliminary thinking and discussion on the "legal countermeasures against terrorism", which is an academic focus, in order to enrich the study of the legal theory of anti-terrorism in China. China has made some achievements in maintaining national security and serving public order in line with the actual needs of China in its struggle against terrorism. On the basis of clarifying the basic understanding of terrorism, the basic idea of the thesis is to expound the experience of the major western countries in the anti-terrorism legal system, and to analyze the current situation of China's anti-terrorism legislation. Thus, the author puts forward the conception and countermeasures to perfect the legal barrier of anti-terrorism in China. The main body of the thesis is divided into four parts. The first part is an overview of terrorism. How to correctly understand terrorism needs to grasp several key points to make an essential elaboration. It includes the definition and characteristics of terrorism, the social origin of terrorism, the political background, the development trend of contemporary terrorism and so on. Through the combing and analysis of these aspects, it provides a logical support for the legal countermeasures of anti-terrorism. The second part is the experience of anti-terrorist legal system in major western countries. This paper enumerates the legislative experience of four western countries, the United States, Russia, Britain and Germany, and makes reference to the third part of the thesis. The third part is the perfection of China's anti-terrorism legal system. This paper points out the necessity of perfecting China's anti-terrorism legislation, and at the same time, analyzes and enumerates the current situation of anti-terrorism legislation scattered in various branches of law, and makes a concrete analysis on how to perfect China's anti-terrorism legislation. The conclusion points out that it is not enough for counter-terrorism activities to rely closely on legal countermeasures. The fundamental approach is also to comprehensively manage society and proceed from the various aspects of nationality, religion, culture, education, and so on, which form the basis of terrorism. The establishment and improvement of a coordinated and effective social policy mechanism is the fundamental way to solve the problem of terrorism.
