社会发展的人权尺度初探

【摘要】：当前,人权问题引起了国际社会的高度关注,同时,它也是我国社会发展进程中一个不可回避的基本问题。近年来,随着人权问题导致的不良影响越来越突出,人权的尺度价值——即以人权为尺度衡量、判断、引导社会发展,受到了学术界越来越多的重视。人权尺度论题的研究,是解决我国在国际关系和国际斗争中的人权问题的客观需要,是促进当前我国人权事业的发展的内在要求,对促进我国社会和人权协调发展具有重要的指导意义。 人权尺度是什么?人权何以能成为社会发展的尺度?人权尺度对我国当前人权事业有何启示?这些问题都是研究人权尺度的核心命题所在。人权是历史的产物,它富于人道精神、法治精神和大同精神,是人之作为人依其本性所享有或应当享有的权利。在社会发展评价尺度体系中,生产力尺度和人的发展尺度是其最基本的两个尺度,而人权是其具体的、重要的尺度,是人的尺度的重要方面。人权作为社会发展的尺度,其内容十分丰富。从标准模型的角度来说,人权尺度的内容包括实现人权最全面、最充分、最协调的发展三个基本维度。从一般意义上说,人权尺度的内容是指尊重、保障、充分实现人类的生存、自由、平等等基本权利、个人的经济社会文化权利、发展权等三个基本方面。从社会发展的基本领域来说,人权尺度的内容包括对经济领域、政治领域、文化领域的人权的发展的基本规定和要求。人权之所以能成为社会发展的尺度,是由人权发展同社会发展的紧密联系所决定的。从宏观上说,人权发展是社会发展的内在要求和重要标志;人权发展与社会发展是相互制约、相互促进,辩证统一的。从微观上说,人权作为社会发展的尺度是有其内在依据的——在经济领域,人权的实现与发展是生产力和生产关系的发展的重要标志;在政治领域,人权的实现与发展是政治民主与法治发展的基本准则;在精神文化领域,人权的实现与发展是文化发展的固有内容和重要标志。当前我国正处于社会主义初级发展阶段,根据人权尺度对我国人权事业的优缺点的客观考量,我们要优先发展生存权和发展权,健全人权法律保障体系,强化政府的人权保障职责,促进教育民主化,从而以科学发展推动人权发展,实现社会同人权的协调统一发展。
[Abstract]:At present, the human rights issue has aroused the international society's high attention, at the same time, it is also an unavoidable basic question in the social development process of our country. In recent years, with the negative influence caused by human rights problems becoming more and more prominent, the yardstick value of human rights, that is, judging and guiding social development by human rights as a yardstick, has been paid more and more attention by academic circles. The study of human rights scale is an objective need to solve the human rights problems in international relations and international struggles in China, and is an inherent requirement to promote the development of human rights cause in our country at present. It has important guiding significance to promote the coordinated development of our society and human rights. What is the yardstick of human rights? How can human rights become the yardstick of social development? What are the implications of human rights standards for China's current human rights cause? These problems are the core proposition of human rights research. Human rights are the product of history. They are full of humanism, the spirit of rule of law and the spirit of great harmony. They are the rights that human beings enjoy or should enjoy according to their nature. In the social development evaluation scale system, the productivity scale and the human development scale are the most basic two scales, while the human rights is its concrete, important scale, is the important aspect of the human scale. Human rights as a measure of social development, its content is very rich. From the point of view of standard model, the content of human rights scale includes three basic dimensions: the most comprehensive, the most adequate and the most coordinated development of human rights. Generally speaking, the content of human rights standards refers to three basic aspects: respecting, guaranteeing, fully realizing the basic rights of human existence, freedom, equality, individual's economic, social and cultural rights, and the right to development. In terms of the basic field of social development, the content of human rights measures includes the basic provisions and requirements for the development of human rights in the economic, political and cultural fields. The reason why human rights can become the yardstick of social development is determined by the close relation between human rights development and social development. From the macro point of view, the development of human rights is the internal requirement and important symbol of social development, and the development of human rights and social development is mutually restricted, mutually promoted and dialectically unified. From a microcosmic point of view, human rights as a measure of social development have their intrinsic basis-in the economic sphere, the realization and development of human rights is an important symbol of the development of productive forces and relations of production; in the political sphere, The realization and development of human rights is the basic criterion for the development of political democracy and rule of law, and in the field of spiritual culture, the realization and development of human rights is the inherent content and important symbol of cultural development. At present, our country is in the primary stage of socialist development. According to the objective consideration of the merits and demerits of our human rights cause in terms of human rights, we should give priority to the development of the right to survival and development, and improve the legal protection system for human rights. To strengthen the government's duty of protecting human rights, to promote the democratization of education, to promote the development of human rights with scientific development, and to realize the harmonious and unified development of society and human rights.
