英国大臣与文官之间的权力平衡 ——1970年以来大臣与文官之间权力关系的研究

一直以来英国文官制度都是政治领域研究的一项重要课题,有关文官制度的著作也很多。而大臣与文官的权力关系则是有关英国文官制度讨论中最具争议也最难阐释的问题之一。大臣与文官的关系是在威斯敏斯特模式下形成的,这一模式下两者有着互惠合作的权力平衡关系,在现实中,还有其他很多因素也影响着两者关系。由于影响大臣与文官权力关系的因素很多,本文重点论述对其影响最显著的一些客观因素。英国大臣与文官之间的关系对于政府的顺利有效运行有着至关重要的意义,因为上述两者在政府中享有很大权力。但很多关于文官与大臣的研究都将两者分别论述,而没有联系在一起。这种情况在我国相关领域尤为明显。因此,本文试图从理论及现实条件下探讨大臣与文官两者关系,尤其是1970年以来英国文官制度经历了一系列改革,两者权力平衡因此也受到较大影响,不少学者对此展开了论述和辩论。本文通过分析讨论相关专家所做的研究,大臣与文官的传记及自传,引言和实例,结合英国政府及宪法的构建框架,表明在现实条件及1970年以来的改革影响下,大臣与文官的权力是比较平衡的。尽管在实际条件下两者权力分配并非固定而严格遵守威斯敏斯特模式的规定,但即使在最近的改革影响下,两...
