魏晋礼法之士与晋律

【摘要】: 本论文以贾充、荀勖、荀榃、杜预、傅玄、郑冲、何曾等魏晋礼法之士为主要研究对象,对礼法之士的形成、思想主张及他们与晋律的关系作了系统地梳理。 礼法之士是魏晋之际特有的一个士人群体。他们是建安时期的名法派与儒士派相互融合的结果:儒士派吸纳了名法派循名责实的方法、务实重事功的思想、“因循”权变的特点;名法派则在“治平赏德行”的理论指导下,强调儒家礼教的作用。总之,名法派与儒士派在思想上的距离越来越小,在魏晋之际融为一体。思想家王肃借鉴了荀子以礼释法的方法,以“礼”调和儒法思想——将“礼”作为契合点,强调“礼”作为法的原则的根本地位,,标志着礼法派的理论体系初步形成。傅玄的学说则是礼法派理论的成熟形式,它集中体现了礼法之士政治法律思想的特点,即儒家礼治主义和“因循”权变、重事功尚实效。在傅玄看来,国之大本存于礼,礼是根本、是法的原则。在实际运用中,他则要求在以礼为经的前提下,根据不同情形或者用礼或者用法。但是儒家伦理道德对他而言并不是一种信仰,而是一种统治权术和工具。 礼法之上直接参与晋律的修订,可以说晋律儒家化即是礼法之士政治法律思想法律化的直接结果。一方面,八议、已出女不从坐、准五服以制罪等魏律内容在晋律中的再现都与礼法之士密切相关;另一方面,礼法之士又使晋律儒家化出现了变异:首先他们所确立的部分礼律是变礼而非纯正的儒家礼仪,其次他们不但带头破坏礼律的规定而且将礼律作为党争的工具。杜预的晋律注与晋律有相同的法律效力,晋律严格区分律令作用和性质及其“简直”的特征都是在杜预的理论指导下实现的。
[Abstract]:In this paper, Jia Chong, Xunxu, Xunyu, du Bei, Fu Xuan, Zheng Chong and he Zeng are the main research objects.The personages of etiquette and law were a special group of scholars during the Wei and Jin dynasties.They are the result of the mutual fusion of the famous and Confucian schools in Jian'an period: the Confucian school absorbed the method of following the name and the responsibility of the famous law school, the pragmatic thought of attaching importance to the work, and the characteristic of "following the rule";Under the guidance of the theory of "governing and appreciating morality", the nominalist school emphasizes the role of Confucian ethics.In a word, the ideological distance between the famous Legalist School and the Confucian School became smaller and smaller, and merged into one at the time of the Wei and Jin dynasties.Wang Su, a thinker, drew lessons from Xun Zi's method of interpreting the law by ritual, reconciled the thought of Confucianism and law with "propriety", and emphasized the fundamental position of "propriety" as the principle of law, which marked the initial formation of the theoretical system of the school of etiquette and law.Fu Xuan's theory is the mature form of the theory of ritual school, which embodies the characteristics of the political and legal thoughts of the scholars of etiquette and law.In Fu Xuan's view, the great state of existence in the ceremony, ceremony is the fundamental, is the principle of law.In practice, he requires that ritual be used or used according to different situations.But Confucian ethics to him is not a belief, but a ruling power and tools.It can be said that Confucianism of Jin Law is the direct result of legalization of political and legal ideology.On the one hand, on the one hand, the content of Wei's laws, such as "eight opinions", "women have not taken their seats", and so on, are closely related to the reappearance of the law of the Jin Dynasty; on the other hand,The Confucianization of the law of the Jin Dynasty appeared the variation: first, some of the rules of etiquette they established were the changing rites rather than the pure Confucian etiquette; secondly, they not only took the lead to break the regulations of the law of ritual, but also took the law of ritual as the tool of the party dispute.Du Bei's note on Jin Law has the same legal effect as Jin Law, and the Jin Law strictly distinguishes the role and nature of law and its "absolute" characteristics, which are realized under the guidance of du Bei's theory.
