论清代徽州禁约合同——以俞藏48件徽州禁约文书为中心

【摘要】：禁约合同是同族、同村人等为禁止盗窃、砍伐树木、保护来龙与水口等事务,共同立约承诺并议定罚则的合同文书。其适用领域广泛,类型多样,订立主体多为宗族、会社以及数姓的联合;内容上更多地体现为禁止、惩罚等强制性规范。对违禁行为进行私力救济或"呈官究治",保证了禁约合同效力的实施。作为国家法的必要补充和延伸,禁约合同在基层社会秩序的构建中扮演了十分重要的角色。
[Abstract]:The proscription contract is a contract document of the same family, the same village people, etc., to prohibit theft, cut down trees, protect the dragon and Shuikou, etc., and make the promise and agree on the punishment together. Its application field is extensive, the type is diverse, the main body is the clan, the club and the several surnames union; the content is more embodied in the prohibition, punishment and other mandatory norms. Private relief or "official investigation" for the prohibited acts ensures the enforcement of the validity of the proscription contract. As a necessary supplement and extension of national law, proscription contract plays a very important role in the construction of grass-roots social order.
