民国东吴大学法科的建立及其影响新议

【摘要】：东吴大学法科作为近代中国法律教育史上的著名法学院校,历来备受学界关注,但在创办之初,它与圣约翰大学的联系却不被世人所知。卜舫济与兰金对法律教育曾经有过不同的见解,但在培养信奉基督教的法律人这一点上达成了一致,东吴法科的教学也曾一度披上了宗教的外衣,直接影响到了其毕业生吴经熊的英美法水平不被美国大法官霍姆斯等人认可。一九二○年后,法科的办学重回正轨,并且确立了以英美法和比较法为教学特色,进而也对上海其他法律院校的教学产生了影响,例如国立暨南大学法律系几乎照搬了东吴法科的办学模式,这也体现出了东吴法科对近代上海法学教育的推动作用。
[Abstract]:As a famous law college in the history of legal education in modern China, the law department of Soochow University has always attracted the attention of scholars, but at the beginning of its establishment, Its association with St. John's University is not known to the world. Bofangzi and Rankin once had different views on legal education, but they agreed on the cultivation of Christian lawyers. The teaching of Soochow Law was once dressed in the guise of religion, which directly affected the Anglo-American law level of its graduate, Wu Jingxiong, and was not recognized by US Justice Holmes and others. Since 1920, the school of law has returned to the right track. It also established the characteristics of Anglo-American law and comparative law, which also influenced the teaching of other law schools in Shanghai. For example, the law department of National Jinan University almost copied the mode of running a school of dongwu law course. This also reflects the promotion of law education in modern Shanghai by the science of law of Soochow.
