日汪条约关系研究(1940-1945)

【摘要】:自1940年3月30日汪精卫在南京成立“中华民国国民政府”,到1945年8月16日陈公博宣布解散该“国民政府”,在这段时间,可以以《基本关系条约》和《同盟条约》为基点,将日汪关系划分为两个阶段。第一个阶段,日本通过与汪伪签订《基本关系条约》确认在华政治、经济、外交、金融特权;第二个阶段,日汪通过《同盟条约》确认双方的“平等关系”,日本“放弃”部分在华权益。日汪关系全方位调整,从初期仅仅把汪伪政权作为否定蒋介石政权的象征,到后来提升汪伪政权统治力和国际地位,形成日汪同盟。本文《日汪条约关系研究(1940-1945)》正是以这两个条约为中心,运用条约法相关理论,从新角度阐述日汪关系变化,从而更加深刻地全面地理解条约在日汪关系发展过程中的重要作用和意义。 第一章“日满条约关系的考察”。论述了日本统治东北模式的选择,详细讨论日本为何采用建立“满洲国”的方式来实现对中国东北的统治,分析了《日满议定书》在实现日本特权方面的重要作用。本章之所以论述日满条约关系,主要用意在于,为日后汪伪政权的建立提供借鉴,以此来分析日本在中国各地的不同统治模式。 第二章“汪伪政权的建立”,初步介绍了在抗日相持阶段,日军鼓动汪精卫出马成立政权的原因,分析了在汪伪政权建立的过程中,日汪之间为争夺各自权益产生的矛盾和冲突,论述了日方对汪伪政权采取分而治之的策略的过程。 第三章“日汪基本关系的确立”,叙述了日汪双方建交谈判的背景、过程、结果,分析了日本如何通过《基本关系条约》的签订,促使其在华政治地位、经济利益、驻军权的合法化,并着重论述了在《基本关系条约》指导下日汪间的合作过程。 第四章“日汪同盟关系的确立”。进入太平洋战争后期,日本因外部环境的恶化而转变对华策略。通过废除治外法权和交还租界,增强汪伪政权自身力量,提升汪伪的国际地位,最后签订《同盟条约》,建立日汪同盟体制。这一系列努力,改变了前期形成的日汪不平等关系,形成日汪同盟关系,其目的是便利日本进一步从中国获取战争所需的物资和政治支持。通过对日汪同盟关系的评析,得出日汪的“平等”关系确立只是流于表面,并不能从本质上改变日本侵华的本质。 最后的余论部分,总结了日汪条约关系的特点,分析了汪伪政权同伪满的不同之处,辩证的看待日汪《基本关系条约》和《同盟条约》的非法性,同时针对这两个条约的实际效用做了论述。最后得出,无论日汪之间签订何种类型的条约,日本的目的只是想通过条约来增强在华统治,而不是实现日华真正的平等。
[Abstract]:From the establishment of the "National Government of the Republic of China" by Wang Jingwei in Nanjing on March 30, 1940, and the announcement of the dissolution of the "National Government" by Chen Gongbo on August 16, 1945, this period can be based on the basic Relations Treaty and the Treaty of Alliance. The Japanese-Wang relationship was divided into two stages. In the first stage, Japan confirmed its political, economic, diplomatic and financial privileges in China through the signing of the Treaty of basic Relations with Wang Puppet; the second stage, Through the "Treaty of Alliance", Japan confirmed the "equal relations" between the two sides, and Japan "abandoned" some of its rights and interests in China. Japanese-Wang relations were adjusted in all directions, and from the initial stage only the puppet Wang regime was regarded as a symbol of negation of Jiang Jieshi's regime. Later on, Wang pseudo-regime 's ruling power and international status were promoted to form a Japanese-Wang alliance. This article, "the study of Japanese-Wang Treaty Relations (1940-1945)", took these two treaties as the center and used the relevant theories of treaty law to expound the changes of Japanese-Wang relations from a new angle. Therefore, the important role and significance of the treaty in the development of Japanese-Wang relations are fully understood. The first chapter, "the investigation of Japan-Manchuria Treaty Relations", discusses the choice of Japan's model of ruling the Northeast, and discusses in detail why Japan has adopted the method of establishing "Manchukuo" to realize its rule over the Northeast of China. This chapter analyzes the important role of the Rizumi Protocol in the realization of Japan's privilege. The main purpose of this chapter is to provide reference for the establishment of the puppet regime of Wang in the future. This is used to analyze the different patterns of Japanese rule in various parts of China. The second chapter, "the establishment of Wang pseudo-regime", introduces the reasons why the Japanese army agitated Wang Jingwei to set up a political power during the anti-Japanese standoff period, and analyzes the process of the establishment of Wang pseudo-regime. In order to fight for the contradictions and conflicts between Japan and Wang, this paper discusses the process of Japan adopting the strategy of division and rule over Wang pseudo-regime. The third chapter, "Establishment of the basic relationship between Japan and Wang", narrates the background, process and result of the negotiation between Japan and Wang on the establishment of diplomatic relations, and analyzes how Japan can promote its political status and economic interests in China through the signing of the Treaty on basic Relations. The legalization of garrison power and the process of cooperation between Japanese kings under the guidance of the basic Relations Treaty are emphasized. Chapter four, "Establishment of Japan-Wang Alliance". After entering the late Pacific War, Japan changed its strategy towards China because of the deterioration of the external environment. By abolishing extraterritorial jurisdiction and returning concessions, Japan strengthened the power of the puppet regime itself. To enhance the international status of Wang Puppet, finally sign the "Treaty of Association," and establish the Japanese-Wang Alliance system. This series of efforts has changed the unequal relations between Japan and Wang, formed in the early days, and formed the Japanese-Wang alliance. Its purpose is to facilitate Japan to obtain further material and political support for the war from China. Through the analysis of the Japanese-Wang alliance, it is concluded that the establishment of the "equal" relationship between Japan and Wang is only superficial. It cannot change the essence of Japan's invasion of China in essence. The last part summarizes the characteristics of the Japanese-Wang treaty relationship, analyzes the differences between the Wang puppet regime and the puppet Manchu regime, and dialectically views the illegality of the Japanese-Wang Treaty of basic Relations and the Treaty of Association. Finally, no matter what kind of treaty is signed between Japan and Wang, the purpose of Japan is only to strengthen its rule in China through treaties, not to realize the true equality of Japan and China.
