近代租借地城市土地产权管理制度的变革及渊源

【摘要】:近代城市土地管理制度的变革形成了不同的路径,其中租借地城市土地管理制度的变革有的有明显的移植和独创的特征,有的则有明显的"二元化"特征。以青岛和威海为例,二者同为租借地城市,但在土地产权管理制度的变革中,一个移植了西方的制度,确立了较为完善的近代化的土地产权管理制度,一个却更多地保留了中国传统的制度。制度的不同变革模式既有德、英不同法律传统的影响,又有文化的影响。
[Abstract]:The transformation of modern urban land management system has formed different paths, some of which have obvious characteristics of transplantation and originality, and some have obvious characteristics of "dualization".Taking Qingdao and Weihai as examples, both of them are lease cities, but in the reform of land property right management system, a western system has been transplanted, and a more perfect modern land property management system has been established.One, however, retains more of the traditional Chinese system.The different reform models of the system have both the influence of morality, the influence of different legal traditions in England and the influence of culture.
