【摘要】：谢觉哉是中共老一辈无产阶级革命家,是新中国法学界的先导,是人民司法制度的奠基者之一。人民调解工作产生于第二次国内革命战争时期,谢觉哉的人民调解思想是对过去中共领导下的人民调解工作的理论上的总结和升华。同时,谢觉哉的人民调解思想作为陕甘宁边区多种因素结合的产物,反过来对当时陕甘宁边区的社会建设产生了深远的影响。本文对谢觉哉的人民调解思想做了比较系统的研究,全文结构分为前言、正文和结语三块。其中正文共分为四部分：第一部分介绍谢觉哉人民调解思想形成的背景,包括政治背景、现实动力和实践基础；第二部分阐述了谢觉哉人民调解思想的主要内容,包括调解的原则和形式；第三部分分析了谢觉哉人民调解思想的特点；第四部分论述了谢觉哉人民调解思想对陕甘宁边区社会建设的影响。谢觉哉作为人民司法制度的奠基人,其人民调解思想是对陕甘宁边区政府时期调解工作的高度总结。系统地研究谢觉哉的人民调解思想的主要内容、特点和影响,有助于人们从一个侧面了解陕甘宁边区政府工作的态度和方向,对当前我国人民调解的立法和实践工作也可以提供一定的历史借鉴。
[Abstract]:It is one of the founders of the new Chinese law field , which is one of the founders of the people ' s judicial system . The people ' s mediation thought is the theoretical summary and sublimation of the people ' s mediation work under the leadership of the Communist Party of China .

This paper makes a systematic study on the thought of people ' s mediation , which is divided into three parts : preface , text and conclusion . The text is divided into four parts : the first part introduces the background of the formation of the thought of the people ' s mediation , including political background , realistic motivation and practical basis ;
The second part expounds the main contents of the thought of the people ' s mediation , including the principles and forms of mediation ;
The third part analyzes the characteristics of the people ' s mediation thought .
The fourth part discusses the influence of the people ' s mediation thought on the social construction of the Shaanxi - Gansu - Ningxia Border Region .

Thank you for being the founder of the people ' s justice system , the people ' s mediation thought is the height summary of the mediation work during the government period of the Shaanxi - Gansu - Ningxia Border Region . The main contents , characteristics and influence of the people ' s mediation thought are studied systematically . It is helpful to understand the attitude and direction of the work of the government in the Shaanxi - Gansu - Ningxia Border Region from one side , and provide some historical reference for the legislation and practice of the people ' s mediation in China .
