“徐州审判”研究

【摘要】：所谓“徐州审判”是指1946-1947年间由徐州绥靖公署组织成立审判战犯军事法庭对所辖地区和范围内日军所犯战争罪行的审判。徐州绥靖公署审判战犯军事法庭是战后国民政府在国内主持成立的10个对日本战争罪犯审判的军事法庭之一,法庭直接隶属于徐州绥靖公署,后经国民政府军事体制改革后,转隶属于陆军总司令徐州司令部。自1946年4月1日成立,至1947年6月5日审判宣告结束,基本完成对境内日本军民侵略行为的基本清算。徐州审判基本贯彻了国民政府“宽大从速”的对日战犯审判政策,对犯有战争罪行的25名战犯嫌疑人判处不同程度的有期徒刑甚至死刑,对确无战争罪行的战犯嫌疑人予以无罪释放,体现了法庭的公平正义、惩恶扬善。因此这一审判不论从军事、政治意义上看,还是从民国司法进步的角度看,都具有十分重要的意义。本文试图从中日两国所藏档案资料入手,借鉴前人的研究思路和成果,分析徐州审判取得的成果和存在的不足。本文主要分五个部分:一是从战后审判战争罪犯这一大时代背景出发,分析国际上是基于何种考虑进行对发动战争的罪犯进行战后清算,然后从国民政府角度出发,分析国民政府在战时做了哪些准备工作,以及这些准备工作对战后战争清算发挥怎样的作用;二是介绍徐州绥靖公署审判军事法庭的成立及权限,人事安排及经费来源等;三是分析徐州法庭审理战犯时,从检察官公诉到法庭判决,从战犯申辩到复审改判等环节;四是举出徐州审判的典型案例进行分析考察;五是对徐州法庭做基本评价并反思其存在的问题,最后探究出审判日本战犯对中日两国的历史意义及现实意义。
[Abstract]:The so-called "Xuzhou trial" refers to the trial of war crimes committed by the Japanese troops in the area and scope under the jurisdiction of the military court set up by the Xuzhou Pacification Office between 1946-1947. The military court of Xuzhou Pacification Office to try war criminals is one of the 10 military tribunals set up by the National Government to try Japanese war criminals in the country after the war. The court is directly subordinate to the Xuzhou Pacification Office, which was later reformed by the military system of the National Government. Transferred to the commander-in-chief of the army Xuzhou Command. From its establishment on April 1, 1946 to the end of the trial on June 5, 1947, it basically completed the basic liquidation of the Japanese military and civilian aggression in the territory. The trial in Xuzhou basically carried out the national government's policy of "lenient and prompt" trials against Japanese war criminals, and sentenced 25 war criminals suspected to commit war crimes to various degrees of fixed-term imprisonment or even the death penalty. The acquittal of war criminal suspects without war crimes reflects the fairness and justice of the court and the punishment of evil. Therefore, this trial is of great significance both in military, political and judicial progress in the Republic of China. This paper attempts to analyze the achievements and shortcomings of the Xuzhou trial by referring to the previous research ideas and achievements, starting with the archival data collected from China and Japan. This paper is mainly divided into five parts: first, from the background of the era of war criminals trial after the war, this paper analyzes what kind of consideration is taken to carry out the postwar liquidation of war criminals in the international community, and then from the perspective of the national government. This paper analyzes what preparations the National Government has made in the war and how these preparations will play a role in the settlement of the war after the war. The second is to introduce the establishment and authority of the court of Xuzhou Pacification Office, the personnel arrangement and the source of funds, etc. The third is to analyze the links of the trial of war criminals in Xuzhou court, from public prosecution by procurator to judgment by court, from defense of war criminal to retrial and revision of sentence. The fourth is to cite the typical cases of Xuzhou trial for analysis and investigation; five is to make a basic evaluation of the court of Xuzhou and reflect on its existing problems and finally explore the historical and practical significance of the trial of Japanese war criminals to China and Japan.
