《应正论》与唐代前期的严刑思想

【摘要】:自从儒家思想成为主流意识形态,在朝廷中占据优势后,"慎狱恤刑"的宽政就成了统治者的指导思想。我们现在看到的经过选择的唐代史料,大部分都是主张宽政的。其实在宣扬宽政的思潮之下,也有着主张严刑的实际执法思想。一向不为人注意的《应正论》就是提倡严刑的一篇珍贵文献。作者王志a在这篇文章中为了支持自己的严刑思想,不惜曲解地提供了释、道、儒三家经典的论据,反映了鲜明时代特点,尤为罕见,值得研究唐代法律及其思想的学者高度重视。
[Abstract]:Ever since Confucianism became the mainstream ideology and gained an advantage in the imperial court, the lenient policy of "careful imprisonment and compassionate punishment" has become the guiding ideology of the rulers. The selected historical materials of the Tang Dynasty that we see now, Most of them advocate leniency. In fact, under the ideological trend of advocating leniency, There is also an idea of actual law enforcement in favour of severe punishment. The "right Theory", which has not always been noticed by people, is a valuable document advocating severe punishment. In this article, author Wang Zhia-cai has misinterpreted his interpretation and Tao in order to support his thoughts on severe punishment. The arguments of the three Confucian classics, reflecting the distinctive characteristics of the times, are particularly rare and are worthy of great attention by scholars studying the laws and ideas of the Tang Dynasty.
