从国际法视角解读13世纪前后蒙古族法律变迁

【摘要】：13世纪蒙古族进行的扩张战争和历史,一直受到世界所瞩目和研究,学界取得了丰硕的研究成果。其中,对蒙古族的法律特别对成吉思汗法典的研究一直很活跃,并且还在继续深入研究之中,因为这种研究具有重要的历史和现实意义。从国际法视角分析13世纪前后蒙古族法律变迁,解读和论述习惯法的起点和基础地位、成文法的推进和发展作用、以法治国与以礼治国相结合的治国理念和特点,以及成文法体系的瓦解和多元法律的融合过程,对于我国的依法治国与和平崛起具有一定的借鉴意义。
[Abstract]:The expanding war and history of the Mongols in the 13th century have been attracting the world's attention and research, and the academic circles have made fruitful research achievements. Among them, the study of Mongolian laws, especially the Genghis Khan Code, has been very active. And it is still in the process of further study, because this research has important historical and practical significance. From the perspective of international law, this paper analyzes the legal changes of the Mongols around the 13th century, and interprets and discusses the starting point and the basic position of customary law. The promotion and development of statutory law, the combination of the rule of law and the rule of propriety, the disintegration of the statutory system and the amalgamation of the pluralistic law. For our country's rule of law and peaceful rise has certain reference significance.
