两宋士大夫法律素养之考量——兼与“两宋士大夫‘文学法理,咸精其能’说”商榷

【摘要】："文学法理,咸精其能"并非两宋士大夫法律素养的普遍状态。从两宋时期"吏强官弱"的司法生态以及"阿云之狱"中士大夫们的整体表现,可以看出两宋士大夫群体的法律素养并不是很高。对于中国古代法律文化而言,只有建立在客观事实基础上的判断,才有益于该问题的进一步探究。
[Abstract]:"Literary legalism" is not the universal state of the legal literacy of the literati in the two Song dynasties. From the judicial ecology of "officials strengthening officials and weak" in the Song Dynasty and the overall performance of the literati and officials in "A Yun Jail", It can be seen that the legal literacy of the literati and bureaucrats in the Song Dynasty is not very high. For the ancient Chinese legal culture, only the judgment based on the objective facts can benefit the further exploration of the problem.
