汉代女性财产权研究

【摘要】：女性财产权的真实情况在一定程度上能够折射出其生活实态,进而反映整个社会风貌。汉代是中国历史上政治与文化的大发展时期,同时也是新旧制度相互碰撞的变化期,这一时期的特殊性使得女性的财产权呈现出鲜明的时代特征。这极具特色的女性财产权的形成是当时社会政治制度、经济发展以及历史传统各方面因素共同作用的结果,更重要的是其涉及了当时的文化思潮。本文结合传世典籍与出土文献,探究两汉女性的财产权,分析总结汉代女性财产权的特征及其成因。首先,汉代婚嫁奢靡之风开始盛行,获得嫁资是汉代女性最基本、最主要的财产权利。通过考察汉代的厚嫁之风,着重分析了嫁妆的种类、数量,并且进一步探讨了汉代女性的奁产权以及嫁妆对女性的意义。其次,阐述汉代女性在家庭中的财产权。根据汉代女性在人生中“为人女”“为人妻”“为人母”不同阶段所扮演的不同角色,论述不同家庭角色的女性在家庭财产方面的权利和地位。再次,阐述汉代特殊阶层女性的财产权利。通过对汉代下层奴婢的财产权和上层贵族女性的财产特权分别进行考察,更加立体地揭示汉代不同阶层女性的财产权状况。最后,分析归纳汉代女性财产权的时代特征和原因。鉴于汉代特殊的时代背景,女性的财产权呈现出明显的时代特征;亦从汉代的社会大背景、儒家理念以及女性地位等方面,分析汉代女性财产权形成的原因。
[Abstract]:To a certain extent, the real situation of women's property rights can reflect the reality of their life, and then reflect the whole social landscape. The Han Dynasty was a period of great development of politics and culture in the history of China, and also a period of change in which the old and new systems collided with each other. The particularity of this period made the property rights of women take on distinct characteristics of the times. The formation of this characteristic female property right is the result of the social and political system, economic development and historical tradition. More importantly, it involves the cultural trend of thought at that time. Combined with the ancient books and unearthed documents, this paper probes into the property rights of women in the Han Dynasty, and analyzes and summarizes the characteristics and causes of the property rights of the women in the Han Dynasty. First of all, the marriage extravagance of the Han Dynasty began to prevail, the acquisition of marriage is the most basic, the most important property rights of women in the Han Dynasty. This paper analyzes the types and quantity of dowry, and further discusses the property right of dowry and the significance of dowry to women in Han Dynasty. Secondly, it expounds the property rights of women in the family in Han Dynasty. According to the different roles played by the women in the Han Dynasty in different stages of "being a woman" and "being a wife" and "being a mother", this paper discusses the rights and status of women with different family roles in family property. Thirdly, expound the property rights of the special class women in Han Dynasty. Through the investigation of the property rights of the slaves of the lower classes of the Han Dynasty and the property privileges of the upper aristocratic women, the paper reveals the situation of the property rights of the women of different classes in the Han Dynasty more stereoscopically. Finally, the paper analyzes the characteristics and causes of the property rights of women in Han Dynasty. In view of the special background of the Han Dynasty, the property rights of women showed obvious characteristics of the times, and analyzed the reasons for the formation of the property rights of women in the Han Dynasty from the social background of the Han Dynasty, the Confucian concept and the status of women.
