秦汉简牍所见基层官员殴詈现象探析

【摘要】：秦汉简牍中有不少基层官吏间殴詈现象的记载,借此可以窥探当时基层官吏间的关系和相关行政法律规范和管理制度,对秦汉时期的吏治制度有一个具体深入的了解。但以往有关的研究比较少,通过对秦汉简牍中这一现象进行梳理研究,官吏间的殴詈可分为因公和因私两种,并适用于不同的法律体系,法律对于判定因公殴詈有具体的规定和标准。秦朝、汉初和汉中期有关因公殴詈的法律和管理制度不断变化,主要表现为法律适用范围的扩大和处理机构的专门化。
[Abstract]:In the Qin and Han dynasties, there are many records of the affray and oaths between officials at the grass-roots level, which can be used to probe into the relationship between the officials at the grass-roots level and the relevant administrative legal norms and management system. There is a specific and in-depth understanding of the official system in the Qin and Han dynasties. However, there have been few previous studies on this phenomenon in the bamboo slips of the Qin and Han dynasties. The affray and oaths between officials can be divided into two types: official and private. Applicable to different legal systems, the law has specific provisions and standards for judging official affray. The law and management system of official affray in Qin Dynasty, early Han Dynasty and Hanzhong period are constantly changing. The main manifestation is the expansion of the scope of application of the law and the specialization of the handling institutions.
