【摘要】：正律例馆是清代重要的立法机构,且在清中后期对刑部疑难案件的办理提供技术指导及裁量意见,该馆聚集了一批精通刑名知识的官员,在某种程度上代表了清代官方法律知识的最高水平。由于官书史料对律例馆的记载并不充分,并且不同文献对律例馆的记载彼此多有抵牾,导致对于律例馆的设置时间、归隶入刑部的时间、是否常设以及职能演变等基本问题的认知尚存有分歧1,本文结合档案文献等资料,重点对以上问题作出初步考辨。律例馆之初设及归属变动,乃
[Abstract]:As an important legislative body in the Qing Dynasty, the regular Law House provided technical guidance and discretion to the handling of difficult cases of the Ministry of Criminal Affairs in the middle and late Qing Dynasty. It gathered a group of officials who were proficient in the knowledge of criminal names. To some extent, it represents the highest level of official legal knowledge in the Qing Dynasty. Because the records of the official records are not sufficient, and the records of the law houses in different documents are often in conflict with each other, the time for the setting up of the law houses is attributed to the time when they were transferred to the department of punishment. There are still differences in the cognition of the basic problems such as whether to be permanent and the function evolvement. 1.
