清代的户绝财产继承制度及其法文化分析

【摘要】：清代关于户绝财产继承的规定主要体现于律例中,并具有如下几点特征:第一,立嗣与继产的关系极为密切,继产已经成为立嗣的重要目的;第二,不再严格区分收养和立继;第三,限制了亲生女的财产继承权。同时,在户绝财产继承纠纷的处理过程中,官员做出的判决及形成的事例也应被视为清代户绝财产继承制度的重要组成部分。透视清代户绝财产继承制度的建构过程,可将其彰显的法文化内涵概括为三个方面:一是宗法本位主义与宗法伦理的庶民化倾向;二是诉求情理与尊重习惯相结合;三是对利益平衡的追求。
[Abstract]:The regulations of the Qing Dynasty on the inheritance of household property are mainly embodied in the statutes and have the following characteristics: first, the relationship between the heir and the successor is very close, the subsequent property has become the important purpose of the heir, the second, no longer strictly distinguish between adoption and succession; Third, it limits the right to inheritance of one's own daughter. At the same time, in the process of dealing with disputes over the inheritance of household property, the judgment made by officials and the cases formed should also be regarded as an important part of the system of inheritance of property in the Qing Dynasty. Through the construction process of the inheritance system of household absolute property in Qing Dynasty, the connotation of law culture can be summarized in three aspects: one is the tendency of patriarchal clan localization and patriarchal ethics, the other is the combination of appeal for reason and respect for habits.
