环境污染第三方治理法律促导机制研究

【摘要】：环境污染第三方治理作为实现环境法、市场秩序法价值目标的重要实施机制和制度工具,是落实污染多元化共治的制度载体。从环境管理治道变革视角下探讨研究环境污染第三方治理之法理,从制度运行层面探讨推进第三方治理制度之实施,从法律规范方面探讨第三方治理之不足,从市场准入条件下探讨环境污染第三方治理之现状。本文通过法律促导这个切入点,对这种新的环境污染治理模式的法律制度基础进行分析,重点探讨环境污染第三方治理在立法、监管与执法、市场规制法则等方面存在的法律困境。在借鉴国外先进经验的基础上,针对我国工业污染第三方治理所存在的法律困境,提出了完善立法,强化环境监管与执法力度,构建市场规制法则等对策。同时,依据市场规制法的基本原理,对构建我国工业污染第三方治理的市场规制法则进行了初步探索,具有深远的理论和现实意义。
[Abstract]:Third party governance of environmental pollution is an important implementation mechanism and system tool to realize the value goal of environmental law and market order law. From the perspective of environmental management and governance reform to explore the third party environmental pollution governance of the legal theory, from the operational level of the system to promote the implementation of the third party governance system. From the aspects of legal norms to explore the deficiencies of third-party governance, from the market access conditions to explore the current situation of third-party governance of environmental pollution. This paper analyzes the legal system foundation of this new environmental pollution control model, and focuses on the third party management of environmental pollution in legislation, supervision and law enforcement. On the basis of the advanced experience of foreign countries, the author puts forward the perfect legislation in view of the legal dilemma of the third party management of industrial pollution in our country. At the same time, according to the basic principle of the market regulation law, the paper makes a preliminary exploration on the construction of the market regulation law of the third party management of industrial pollution in China. It has profound theoretical and practical significance.
