生态消费法原理研究

【摘要】：生态消费的产生,是我国建设资源节约社会的必然选择,也是历史进程中重要的转折。我国地大物博,自然资源是人类与自然界的关系纽带,人类的消费行为与消费方式逐渐带来自然资源危机。21世纪全球面临着生态危机带来的巨大挑战,人类在这场带有灾难性的挑战之中扮演了关键角色。人类的不合理消费、欲望消费、无限制消费的产生,将严重扰乱并腐蚀社会风气,并且会带来的不可挽回的灾难产生。基于此,我们要改变我们一贯的传统消费模式,改变原有的不良消费行为,将生态消费这种绿色化消费模式观察与生活于制度当中。本文的研究起点是基于在改变人类消费模式,消费思维之时,运用法律思维对生态消费的建设及可行性进行思考。生态消费的产生是超越了传统消费形式的重大突破,其调整人类社会生活的方式,应当受到法律的规范及调整,这种规范人类消费,在消费领域起到带头作用的法规体系。全文从生态消费的基本认识为起点,通过研究何为人类基本需要,消费在人类生活的重要性等问题。首先根据原始社会时期、农业文明时期、工业文明时期作为时间线索,整理出人类发展的历史长河当中消费现象因时代不同其存在方式也有所不同。其次,通过生态消费与其外延概念进行梳理与比对,提出生态消费的概念以及生态消费法的概念。再次,研究生态消费法的体系,阐述其基本原则与制度,通过研究域外相关法律制度,吸收并学习总结我国生态消费法制度中的不足及需要改进的地方。最后,构建一种属于中国特有的生态消费法的责任机制,在《民法》绿色化的思路中构建良好的激励机制或惩罚机制,希望通过全文对生态消费法原理分析,将不合理的消费行为加以规范,矫正。
[Abstract]:The emergence of ecological consumption is an inevitable choice for building a resource-saving society in China, and also an important turning point in the historical process. Natural resources are the link between human beings and nature. Human consumption behavior and consumption mode gradually bring natural resources crisis. The world is facing the enormous challenge brought by ecological crisis in the 21st century. Humanity has played a key role in this disastrous challenge. The irrational consumption, desire consumption and unlimited consumption of human beings will seriously disturb and corrode the social atmosphere and bring about irreparable disasters. Based on this, we should change our traditional consumption mode, change the original bad consumption behavior, observe the green consumption pattern of ecological consumption and live in the system. The research starting point of this paper is based on the use of legal thinking to reflect on the construction and feasibility of ecological consumption while changing human consumption mode and consumption thinking. The emergence of ecological consumption is a major breakthrough beyond the traditional consumption form. The way of adjusting human social life should be regulated and adjusted by law. This kind of normative human consumption plays a leading role in the legal system of consumption. Starting from the basic understanding of ecological consumption, this paper studies the basic needs of human beings and the importance of consumption in human life. First, according to the primitive society period, agricultural civilization period, industrial civilization period as a time clue, sort out the history of human development in the long history of the phenomenon of consumption due to different times its existence is different. Secondly, through combing and comparing the concept of ecological consumption and its extension, the concept of ecological consumption and the concept of ecological consumption method are put forward. Thirdly, this paper studies the system of ecological consumption law, expounds its basic principles and systems, absorbs and summarizes the deficiencies of the ecological consumption law system and the areas that need to be improved by studying the relevant legal systems outside the country. Finally, we construct a kind of responsibility mechanism of ecological consumption law that belongs to China, and construct a good incentive mechanism or punishment mechanism in the green thinking of "Civil Law". We hope to analyze the principle of ecological consumption law through the full text. The unreasonable consumption behavior should be standardized and corrected.
