关于提高外观设计专利网络证据检索效能的思考

【摘要】：随着互联网技术的快速发展和普遍应用,网络证据广泛应用于各个行业和领域。特别是在知识产权领域,大量的网络证据可用于专利检索,有助于提高外观设计专利的质量同时,对促进知识产权保护和应用也具有非常重要的意义。本文以淘宝的网络证据应用于专利权评价报告为例,梳理其在外观审查中的应用现状和资源状况,分析淘宝检索资源的局限性,有针对性地提出解决问题的具体建议,为进一步促进外观设计专利网络证据检索及应用、做好外观设计专利审查工作提供参考。
[Abstract]:With the rapid development and widespread application of Internet technology, network evidence is widely used in various industries and fields. Especially in the field of intellectual property, a large amount of network evidence can be used for patent retrieval, which helps to improve the quality of design patents, and also plays an important role in promoting the protection and application of intellectual property rights. Taking Taobao's network evidence used in patent evaluation report as an example, this paper combs its application status and resource status in appearance review, analyzes the limitations of Taobao's retrieval resources, and puts forward specific suggestions to solve the problem. It provides a reference for further promoting the search and application of the network evidence of design patent and for doing well the examination of design patent.
