法律的文学叙事与历史叙事——从欧阳修的《纵囚论》说起

【摘要】:欧阳修的《纵囚论》作为史论性质的文学作品,旨在通过揭露唐太宗贞观六年的纵囚之事来阐发暗含在政治权术下的虚假和伪善。欧阳修认为唐太宗以所谓的信义释放死囚,既不符合法律惩治死刑犯的程序正义,也违背了大众逻辑下的常规情理,只不过是一种帝王德政形象的塑造和宣示。从唐人的集体性赞颂到宋人而后的群体性批判,欧阳修的指摘在其中的转捩,无疑开启了宋人法律文化思潮的萌蘖。然而,欧阳修的论断只是触及了政治权术表层的意涵,却没有对唐太宗纵囚的缘由根柢进行本质性揭示。实际上,从汉晋至隋唐,历史文本接续中皆存有类似的纵囚事例,这就不能以单向维度的判辨来归因于帝王权力图式影响下的历史书写。唐太宗施展特赦的举措,固然既有帝王德政思维下追求"内圣外王"理想人格的需求,也有蕴含在教化和资治功用下的信义取向。不过,在省思传统政治行为的过程中,我们更需要的是先忘却政治正确与事实真相之间的变换。缕析《纵囚论》,不仅有助于思索自西汉法律儒家化以来的士大夫伦理文化,而且可以藉以追寻探讨经过唐宋变革后的法律文化路径嬗变。
[Abstract]:Ou Yangxiu's theory of longitudinal prisoners, as a literary works of historical nature, aims to elucidate the false and hypocrisy under political power by revealing the six years of Tang Taizong's convictions in the political power. Ou Yangxiu believes that Tang Taizong's release of the death prisoner by the so-called faith is neither in accordance with the procedural justice of the law punishing the death penalty, but also against the logic of the public. The general reason is only a kind of shaping and declaring the image of the emperor's German government. From the collective praise of the Tang people to the group criticism of the song and the people of the song and the latter, the transition of Ou Yangxiu's criticism has undoubtedly opened the tiller of the ideological trend of the song's law and culture. However, Ou Yangxiu's argument only touched the meaning of the surface of political power, but not to Tang Dynasty. In fact, from the Han Jin to the Sui and Tang Dynasties, from the Han, Jin to the Sui and Tang Dynasties, there were similar cases of the longitudinal prisoners, which could not be attributed to the historical writing under the influence of the imperial power schema by the judgment of the one-way dimension. However, in the process of thinking of traditional political behavior, we need to forget the transformation between the political correctness and the truth, and the analysis of the theory of "the theory of longitudinal prisoners" is not only helpful to think about the ethical culture of the scholar bureaucrats since the Confucianism of the Western Han Dynasty. Moreover, we can explore the evolution of legal culture after Tang and Song dynasties.
