当代文学的一个“公民不服从者”形象——以《生死疲劳》中的“蓝脸”看一个“通过文学的法律”问题

【摘要】：在中国传统社会、传统文化中,文学享有较高的地位,这除了因为文学事关生命存在的意义、人的情感和精神追求以外,从国家治理的角度而言,它也有着极其重要的意义,文学发挥着和"礼"、"法"虽不相同但同样重大的作用。文学是人学,法学的实质其实也是人学。文学就是社会国家的"血肉",而法律则是社会国家的"筋骨"。莫言的长篇小说《生死疲劳》通过"蓝脸"这一重要人物的塑造,以一种隐蔽、潜在但形象、生动的方式,对一个困扰当代中国公共政治生活和国家治理方式的法学问题完成了一次"通过文学的法律"探究的作业。
[Abstract]:In Chinese traditional society and traditional culture, literature enjoys a higher status. This is not only because literature is related to the meaning of existence of life and the pursuit of human emotion and spirit, but also plays an extremely important role in terms of national governance. Literature plays a different but equally important role in "ritual" and "law". Literature is the science of man, but the essence of law is also the science of man. Literature is the flesh and blood of the social state, while the law is the bones and bones of the social state. Mo Yan's novel "Life and death fatigue" through the "Blue face" this important figure, in a hidden, potential but vivid way, This paper deals with a problem of law which puzzles the public political life and the way of national governance in contemporary China.
