知识产权语境下的泰山皮影戏保护研究

【摘要】:非物质文化遗产作为传统文化的一部分,是一个民族或国家集体智慧的结晶、历史文化底蕴的积淀。进入到21世纪,特别是在经济一体化浪潮中,各国政府为了保护本国的智力劳动成果,更加关注对智力成果的知识产权保护,然而原本就处于弱势地位的非物质文化遗产等传统知识却被排除在知识产权保护之外,陷入了侵权和滥用的困境之中。我国种类繁多、类型复杂的非物质文化遗产同样面临着或正在遭遇着来自国内外的此种困境,因此,利用知识产权来保护非物质文化遗产就成为了我国一项必要和紧迫的课题。作为优秀非物质文化遗产代表的泰山皮影戏,经历了挫折与复兴之后,在产业化道路上也面临着侵权与滥用的胁迫,因此,在以《非物质文化遗产法》为代表的公法无法对泰山皮影戏的经济利益提供有效保护时,对泰山皮影戏进行私法保护则成为一种必然。正是在这样的背景下,本文从法律的角度,分析了泰山皮影戏法律保护实践现状及困境,论证了泰山皮影戏知识产权保护的可行性,并提出了一条以著作权、商标权、专利权为主的知识产权保护路径,以期此种路径将有利于泰山皮影戏的产业化发展。本文除绪言与结语外,正文共分为四部分。第一章从泰山皮影戏的起源入手,考察生存发展环境以及当代发展,探究进入新时期之后泰山皮影戏本体的变化,同时对泰山皮影戏的法律保护实践现状及困境进行系统论述。第二章对泰山皮影戏知识产权保护的可行性进行系统分析,分别从“艺术表达形态的独创性”、“家族传承的专有性”、“商业演出的标志性”三方面探寻其满足知识产权保护的必要条件,同时分析泰山皮影戏的市场化道路。第三章对利用知识产权保护泰山皮影戏过程中的薄弱环节进行分析,阐明两者可能会遭遇的困境。第四章分别从“著作权”、“商标权”、“专利权”三方面探索泰山皮影戏的知识产权保护,在确立泰山皮影戏权利主体即传承人的情况下,明确泰山皮影戏权利客体并完善泰山皮影戏权利内容。
[Abstract]:As a part of traditional culture, intangible cultural heritage is the crystallization of the collective wisdom of a nation or a country, and the accumulation of historical and cultural heritage. In 21th century, especially in the wave of economic integration, In order to protect their intellectual labor achievements, governments pay more attention to intellectual property protection, but traditional knowledge such as intangible cultural heritage, which is already in a weak position, is excluded from intellectual property protection. In the predicament of infringement and abuse, there are many kinds of intangible cultural heritage in our country, which are also facing or are encountering this kind of predicament from home and abroad, therefore, The use of intellectual property to protect intangible cultural heritage has become a necessary and urgent issue in our country. As a representative of the outstanding intangible cultural heritage, Taishan shadow play has experienced setbacks and rejuvenation. On the road of industrialization, it is also faced with the coercion of infringement and abuse. Therefore, when the public law represented by "Intangible Cultural Heritage Law" cannot provide effective protection for the economic interests of Taishan shadow play, It is inevitable to protect Taishan shadow play by private law. It is under this background that this paper analyzes the present situation and predicament of the legal protection practice of Taishan shadow play from the angle of law. This paper demonstrates the feasibility of the intellectual property protection of Taishan shadow play, and puts forward a path of intellectual property protection, which mainly includes copyright, trademark right and patent right. This paper is divided into four parts except the introduction and conclusion. The first chapter begins with the origin of Taishan shadow play, and investigates the living and developing environment as well as the contemporary development. After entering the new period, this paper probes into the changes of Taishan shadow play Noumenon, and at the same time systematically discusses the present situation and predicament of the legal protection of Taishan shadow play. The second chapter makes a systematic analysis on the feasibility of the Taishan shadow play intellectual property protection. From the aspects of "the originality of artistic expression form", "the exclusivity of family inheritance" and "the symbol of commercial performance", the necessary conditions for satisfying the protection of intellectual property rights are explored respectively. At the same time, it analyzes the market-oriented road of Taishan shadow play. Chapter three analyzes the weak links in the process of using intellectual property rights to protect Taishan shadow play. Chapter 4th explores the intellectual property protection of Taishan shadow play from the aspects of "copyright", "trademark right" and "patent right" respectively. Make clear the right object of Taishan shadow play and perfect the content of Taishan shadow play right.
