足弓结构破坏与伤残鉴定相关问题研究

【摘要】:根据《礼记》、《吕氏春秋》等的记载,早在春秋战国时期对于损伤的程度及检验方法已有了明文规定。现场勘验、人身检查、尸体检验等方面已经取得了一定的科学成就。唐朝时期,《唐律》中已明文规定了诉讼活动涉及的伤亡病残、人身识别等的检验及处理。可见,在我国古代法医临床检验技术已经得到了一定的发展。 近年来,随着人身损伤案件的日益增多,肢体损伤及损伤部位伤残评定在法医临床司法鉴定实务中非常多见。而肢体损伤中的下肢功能损伤由于其结构的特殊性成为现行司法检案实践中的难点与焦点问题。本文以日常检案中收集的足弓结构破坏案例为研究对象,首先描述足与足弓结构及足弓结构破坏的特征,分析目前足弓结构破坏伤残等级评定的现状,提出当前司法鉴定检案中足弓结构伤残等级评定存在的问题,以便能客观、科学地修订足弓结构破坏伤残等级评定标准,为司法鉴定、法院审判、保险理赔工提供科学的依据。 第一章介绍足部与足弓的解剖学结构。并对足部组成诸骨、韧带、肌腱、各关节及肌肉等层面进行详细描述,着重对足弓(内侧弓、外侧弓及横弓)进行概括性和功能性的描述。 第二章主要分析了足弓结构破坏的形态学特征。分别从医学影像学及临床体征这两个角度出发,,分析当足弓三个结构中任何一个弓遭到破坏时足部医学影像学摄片资料及临床体征的相应改变。 第三章一是主要以表格形式概括论述了我国当前足弓结构破坏伤残等级评定主要的法律依据。二是以华东政法大学司法鉴定中心及华山医院收集的156例足弓结构破坏案例为基础,分析当前足弓结构破坏伤残等级评定主要运用的方法,结合收集的案例分析足弓结构破坏伤残等级评定的现状。三是归纳分析提出目前足弓结构破坏伤残评定中主要存在的问题。 第四章是本文的重点,首先从鉴定、审判、理赔三个方面阐述本文的主要研究意义,其次从实事求是与科学客观、鉴定人遵守行业规范以及鉴定最晚时机出发概括足弓结构破坏伤残鉴定应遵循的基本原则,最后从鉴定标准、鉴定方法、鉴定人员角度系统总结规范我国足弓结构破坏伤残鉴定的可行性路径。
[Abstract]:According to the records of the Book of Rites and Lu's Spring and Autumn period, as early as the Spring and Autumn and warring States period, there were clear provisions on the extent of the damage and the inspection methods. Some scientific achievements have been made in the field of cadaver examination. During the Tang Dynasty, "Tang Law" clearly stipulated the examination and treatment of death, injury, disability, personal identification, etc involved in litigation activities. The technique of forensic clinical examination has been developed in ancient China. In recent years, with the increasing number of personal injury cases, The evaluation of limb injury and injury site disability is very common in forensic clinical forensic practice. The functional injury of lower extremity in limb injury has become a difficult and focal point in the current judicial examination practice because of its special structure. In this paper, we take the cases of arch structure destruction collected in routine examination cases as the research object. This paper first describes the characteristics of foot and arch structure and foot arch structure damage, analyzes the present situation of foot arch structure damage and disability evaluation, and puts forward the problems existing in the evaluation of foot arch structure disability grade in the current judicial appraisal case so as to be objective. In order to provide scientific basis for judicial appraisal, court trial and insurance claim settlement, the evaluation standard of foot arch structure damage and disability grade is revised scientifically. The first chapter introduces the anatomical structure of foot and arch, and describes in detail the composition of foot, including bone, ligaments, tendons, joints and muscles. The lateral arch and transverse arch are described in general and functional terms. The second chapter mainly analyzes the morphological characteristics of arch structure destruction. From the two angles of medical imaging and clinical signs, The changes of medical imaging data and clinical signs of foot were analyzed when any one of the three arch structures was destroyed. The third chapter mainly discusses the main legal basis for evaluating the damage and disability of foot arch structure in our country in the form of table. Second, 156 cases of pedicle knot collected by judicial identification center of east china university of political science and law and Huashan hospital. On the basis of a case of destruction, This paper analyzes the main methods used in the assessment of the damage and disability grade of the arch structure at present. Combined with the collected cases, the present situation of the assessment of foot arch structure damage disability grade is analyzed. Thirdly, the main problems existing in the foot arch structure damage disability assessment are summarized and analyzed. Chapter 4th is the focal point of this paper. Firstly, it expounds the main research significance of this paper from three aspects: identification, trial and claim settlement. Secondly, it expounds the significance of this research from the aspects of seeking truth from facts and science and objectivity. The appraisers abide by the industry norms and the latest time to identify the basic principles that should be followed in the identification of foot arch structure damage and disability. Finally, from the standards and methods of identification, Appraisers systematically summarize and standardize the feasible path for the identification of foot arch structure damage and disability in China.
