【摘要】：社区矫正制度对于我国来说，是一种新的刑罚执行方式，它与监禁矫正是相对的关系，是指将符合社区矫正条件的罪犯安排在社区内，以专门的国家执法机关为主，在相关社会团体和民间组织以及社会志愿者的协助下，在判决、裁定或决定确定的期限内，矫正其犯罪心理和行为恶习，并促进其顺利回归社会的非监禁刑罚执行活动。它主要包括六大特征，即刑事制裁性、非监禁性、社区参与性、惩罚缓和性、对象特定性、直接教育性。它的理论基础主要有五种理论，即刑罚谦抑主义思想、刑罚经济性理论、行刑社会化理论、标签理论、刑事政策理论。它具有三大社会价值，即有利于罪犯重新走上社会；提高了罪犯改造的质量；有利于缓解监狱人满为患的压力，降低行刑成本。当前我国社区矫正制度主要存在三大问题，一、社区矫正立法滞后，包括我国社区矫正的立法不完善、社区矫正的适用对象偏窄、社区矫正的奖惩措施力度不足；二、社区矫正工作机制不健全，包括社区矫正缺乏专门的机构和专门的工作者、我国社区矫正工作缺乏经费保障、我国社区矫正的监督机制不健全；三、社区矫正文化观念上存在不足，包括缺乏社区认同感，制约社区矫正的深入开展；社会公众对社区矫正的认识不足。我国社区矫正制度的完善主要从以下三大方面进行：一、完善社区矫正相关立法，包括立法应当坚持的原则、立法应当采取的模式和修改刑法刑事诉讼法以提高社区矫正刑在刑罚体系中的地位。二、构建完备的社区矫正机制，包括加强社区矫正队伍建设，提高矫正工作者业务水平；建立社区矫正财政经费保障制度；建立科学合理的社区矫正工作制度，提高矫正工作质量；积极创新社区矫正的新形式；健全我国社区矫正的监督机构。三、加强社区建设，转变行刑观念，包括加强社区建设，，为社区矫正提供良好的基础；转变刑罚的执行观念。
[Abstract]:The community correction system for our country, is a new way of penalty execution, it is relative with the imprisonment, is to meet the conditions of community corrections offenders arrangements within the community, with special national law enforcement agencies, in the relevant social groups and non-governmental organizations and community volunteers with the assistance of the the judgment, ruling or decision within the time limit, correct their criminal psychology and behavioral habits, and promote their successful return to society the non imprisonment penalty. It mainly includes six characteristics, namely, criminal sanctions, non imprisonment, community participation, punishment moderation, object specific, direct education. Its theoretical basis mainly consists of five theories, namely, the theory of penalty modesty, the theory of penalty economy, the theory of socialization of execution, the theory of labeling and the theory of criminal policy. It has three social values, that is, it is good for criminals to go back to society. It improves the quality of criminals transformation, and helps to alleviate the pressure of prison overcrowding and reduce the cost of execution.
