社区矫正的法律属性——对社区矫正行刑观的理性思考

【摘要】：关于社区矫正的法律属性,主流观点是将其看作与监禁矫正相对应的一种行刑方式。然而,笔者认为,依这种观点构建中国的社区矫正制度存在诸多弊端。社区矫正不属于刑罚执行方式,不宜纳入刑罚体系,它应当是现有刑罚执行制度以外的一种全新的犯罪预防模式。社区矫正与刑罚执行有着本质的不同。社区矫正的主体是社区,不必拥有刑罚执行权,其实施的内容是矫正,不是惩罚,其矫正的对象也不仅限于罪犯。社区矫正与现有刑罚执行制度没有冲突和矛盾,不用对既有法律作大的修改。
[Abstract]:As to the legal attributes of community correction, the mainstream view is to regard it as a way of execution which corresponds to the correction of imprisonment. However, the author believes that there are many drawbacks in the construction of Chinese community correction system according to this view. Community correction does not belong to the execution of penalty, and it should not be included in the system of penalty. It should be a new mode of crime prevention outside the existing penalty enforcement system. There are essential differences between the community correction and the execution of the penalty. The main body of community correction is the community, which does not have to have the right to execute the penalty. The content of its implementation is correction, not punishment, and the object of its correction is not only limited to the criminal. There is no conflict and contradiction between community correction and the existing penalty enforcement system, and no major amendments to existing laws are made.
