居住证制度行政法研究

【摘要】：改革开放以来,我国市场经济程度加深,工业化、信息化发展迅速,城镇化水平提升,我国的人口结构变化剧烈,户籍制度改革势在必行。但我国尚处于经济社会转型时期,传统城乡二元分化现象依然根深蒂固,现阶段户籍制度彻底改革尚不具备客观条件。居住证制度在这样的背景下进入历史舞台,其是户籍制度改革的软着陆,并将在很长一段时间内承担着流动人口服务管理、调解城市有限资源与人口结构矛盾等方面起重要作用。但现行居住证制度还存在诸多问题,如推行水平参差不齐、居住证全覆盖进程缓慢、配套立法和公共服务落后、福利待遇落实不到位、完善的人口信息库难以建立、行政立法不足、行政职能部门不能形成合力等。本文从行政法角度对居住证制度进行研究。论述了居住证制度的基本概念、主要内容和居住证制度产生发展与实施现状,分析了居住证制度存在的问题与成因,并对居住证的完善提出了三点建议。居住证制度全面推行是为了促进新型城镇化的健康发展,推进城镇基本公共服务和便利常住人口全覆盖,保障公民合法权益,促进社会公平正义。但必须要承认居住证属于过渡时期的产物。因此,在居住证制度推进过程中,务必紧贴户籍制度改革方向——打破城乡二元结构,实现人口的迁徙自由。随著户籍制度改革的不断深入,人口自由迁徙对城市资源承载力的压力越来越小,居住证终将会退出历史舞台。因此,现阶段,我们应当加强居住证制度的立法工作,完善制度保障,提高行政能力,创新行政手段,逐步实现流动人口共享居住地的城市福利待遇,为户籍制度深入改革提供有益经验。
[Abstract]:Since the reform and opening to the outside world, China's market economy has deepened, industrialization, information technology has developed rapidly, the level of urbanization has been raised, and the population structure of our country has changed dramatically. It is imperative to reform the household registration system, but our country is still in the economic and social transition period, the traditional urban-rural dual differentiation phenomenon is still deep-rooted. At present, the reform of the household registration system does not have objective conditions. The residence permit system enters the historical stage under this background, which is the soft landing of the reform of the household registration system. And it will play an important role in the management of floating population service and the contradiction between the limited resources and the population structure in a long period of time. However, there are still many problems in the current residence permit system. For example, the level of implementation is uneven, the process of full coverage of residence permits is slow, the supporting legislation and public services are backward, the welfare benefits are not in place, the perfect population information base is difficult to establish, and the administrative legislation is insufficient. This paper studies the residence permit system from the angle of administrative law, and discusses the basic concept of residence permit system, the main content and the development and implementation of the residence permit system. This paper analyzes the problems and causes of the residence permit system, and puts forward three suggestions for the perfection of the residence permit system. The overall implementation of the residence permit system is to promote the healthy development of the new type of urbanization. To promote basic public services and facilitate the full coverage of the permanent resident population, to protect the legitimate rights and interests of citizens, to promote social equity and justice, but it is necessary to recognize that residence permits are the product of the transition period. In the process of advancing the residence permit system, we must closely follow the direction of the reform of the household registration system-break the dual structure between urban and rural areas, and realize the freedom of migration. With the deepening of the reform of the household registration system. The pressure of free migration on the carrying capacity of urban resources is becoming smaller and smaller, and the residence permit will eventually withdraw from the historical stage. Therefore, at present, we should strengthen the legislative work of the residence permit system and improve the system protection. Improving administrative ability, innovating administrative means, gradually realizing the urban welfare treatment of floating population sharing residence, providing beneficial experience for the further reform of household registration system.
