【摘要】： 犯罪预防是减少和治理犯罪的重要途径,犯罪预防作用的有效发挥能把犯罪消灭在萌芽状态,大量减少犯罪案件的发生,控制犯罪发生的规模。犯罪预防要有效的发挥作用需要采取多种方法,吸纳各种能预防犯罪的积极因素。而佛教伦理是我国传统文化的一个重要部分,其伦理规范对当今我国社会是具有积极作用的。本文主要就是针对中国佛教伦理可以在犯罪预防中发挥的作用展开了研究。本文首先对中国佛教的伦理进行了分析,交待了其去恶行善、平等慈悲、自利利他的三大伦理原则并对佛教伦理的重要伦理规范作出了陈述和解释,这包括:“五戒”、“十善”、“四摄”和“六度”等佛教基本伦理规范;接着,笔者对佛教的犯罪观进行了分析,说明了佛教对“罪”和“人性”的看法、佛教的“罪”和世俗的“罪”的相通之处。着重分析了佛教对罪因的看法,指出佛教认为犯罪除“无明”这个一般原因外还有物质原因、社会原因及个人心理原因。其次,文章的核心部分主要研究了中国佛教伦理在犯罪预防中的作用。在这部分中对犯罪预防的概念和内容进行了介绍,对佛教伦理和犯罪预防的关系进行了分析,从总体上指出佛教伦理可以作为犯罪预防的一个手段,在犯罪预防中发挥作用。接下来,文章列举了导致我国犯罪产生的四个原因:道德滑坡、社会失范、社会慈善事业落后及个人心理原因,针对这四个原因具体分析了佛教伦理的相应作用。为进一步说明佛教伦理在犯罪预防中的作用,文章又分析了其对侵害人身权利犯罪、侵犯财产权类犯罪及破坏环境犯罪这几种常见犯罪的预防作用。通过上述的分析,本文说明了中国佛教伦理在犯罪预防中是能够发挥其积极作用的。最后,在认识到中国佛教伦理对犯罪预防的作用后,本文研究了对佛教伦理的利用方式,这就是要坚持马克思主义的方法论,一分为二地看待佛教伦理,并把它从宗教形态中剥离出来间接利用。在具体方式上,就是要把佛教伦理的利用与我国的精神文明建设结合起来、把佛教伦理应用在犯罪预防体系的多个方面、与其他犯罪预防手段共同作用来预防犯罪。
[Abstract]:Crime prevention is an important way to reduce and control crime, effective crime prevention effect to crime in the bud, reducing the number of criminal cases, the crime control scale. This paper first analyzes the ethical Chinese Buddhism, confessed the evil to goodness, equality and compassion, since the three ethical principles he Lili and important ethical norms on Buddhist ethics made statements and explanations, which include: "Five", "ten kind", "four shoot" and "six degrees" the Buddhist basic ethical norms; secondly, the author analyzes the Buddhist concept of crime, the Buddhist view of "crime" and "human nature", the similarities of Buddhism "sin" and the secular "sin". Focuses on the analysis of Buddhism on crime because of views, points out that crime "in Buddhism no" the general reasons and material reasons, social reasons and personal psychological reasons. Secondly, the core part of the article focuses on the role of China Buddhist Ethics in crime prevention. In this part introduces the concept and content of crime prevention, to the Buddha The relationship between Protestant Ethic and crime prevention are analyzed, from the overall point of Buddhist ethics can be used as a means of crime prevention, play a role in crime prevention. Next, this paper enumerates four causes of crime in our country: the moral landslide, social anomie, social charity backward and individual psychological factors. For these four reasons analyzes the role of Buddhist ethics. To further illustrate the role of Buddhist Ethics in crime prevention, the article analyzes the crime of infringement of personal rights, prevent violations of property rights crimes and destruction of the environment crime these kinds of common crime. Through the above analysis, this paper explains Chinese Buddhist Ethics in crime prevention is able to play its positive role. Finally, in recognition of the Chinese Buddhist ethics to the crime prevention effect, this paper studies the benefit of Buddhist Ethics By the way, this method is to insist on Marx's theory, One divides into two. view of Buddhist ethics, and to keep it from religious form stripping out the indirect use. In concrete ways, is to use the construction of spiritual civilization of Buddhist Ethics in China and combine the Buddhist Ethics in the crime prevention system application one hand, working together with other means of crime prevention to prevent crime.
